Against Dear Assembly Members, Please reject SB 412. It will be a bad law and very hard to enforce. You will destroy the Complimentary Health Field which currently brings in Millions- yes $ millions of dollars to our state. There are sales tax dollars on all the products that the complimentary health practitioners sell. There is money that the practitioners themselves spend in our economy. This bill will drive many of them to either retire, find other work, or move out of state. How can a board of 7 people possibly have enough knowledge to judge all of these different modalities? And the set up and enforcement of this law will cost hundreds of thousands $$$ in legal fees, court costs, lawyer fees (they will benefit from this law). You will destroy an entire industry by passing this law. It is time for you to vote as a Statesman, for the good of the people. I hope you will do your duty and VOTE NO ON SB 412. Jun-02-2011

Against I turn to alternative healing methods because the formal medical community and its processes do not work for me. I get success from alternative methods and would like to continue to exercise my right to choose my healthcare provider without the profit driven Nevada medical community being involved. Against I received a panicked FWD email regarding this bill alleging it "Would make Homeopathy, Nutritional Counseling, Energy Healing, Aromatherapy and even Spiritual Coaching a felony!" While I am a proponent for regulation in the interest of keeping the public safe, I find that spiritual/ energy healing methods to have no scientific boundaries that can be defined thus cannot be regulated. They should be treated as purely a businesses and allowed to function without a medical examiner's board. As for aromatherapy, nutritional counseling, and homeopathy, they can also be regulated under regular business laws and within already set drug laws. There is too little research and consensus to form an agreeable committee, much less a board. As a medical student, I would like these options available for the public and have my patient communicate openly with me. I'm afraid that regulating these practices can potentially eliminate some great alternatives. May-22-2011

Against Homeopathy, Nutritional Counseling, Energy Healing, and Aromatherapy have been proven by hospitals, medical schools and scientific labs to provide complementary wellness benefits to pharmaceuticals and Western medicine techniques. It would be unconstitutional to remove my human right to choose which techniques are best for me and to limit my access to products sold my non-licensed practitioners. Regarding Spiritual Coaching -- there is a clear distinction between church and state in this country. Again, it is unconstitutional to legislate on my religious and spiritual freedoms to received spiritual guidance and coaching from whom I choose...whether licensed or not by the government. Against My mom is now 66 and is not on any perscription drugs and doing much better than she was 20 years ago when she was participating in the Standard AMA practices. She was at one time a very sick women and not a good mom to me because she had no energy. So then I had to be raised by my grandparents because she had a lot of health problems and was pumped up w/all kinds of drugs from the AMA. All the doctors were making her worse w/all the drugs and they weren't supportive in who she was as an individual. Then she discovered the alternative forms of help and she reclaimed her life back. The AMA doctors were telling her things like, "It's all in your head." Then they found out years later what they didn't have a name for before was "Fibromyalsia." But by then, my mom already started getting relief from fibromyalsia by doing the alternative thing. So for all those who don't support the alternative health movement, beware, you are screwing w/people's confidence and choices to reclaim their power and their life back. Most of what my mom was doing to help give her relief was finding support with regular people and not in a clinical office w/framed licenses on the wall. Of course there is a balance between clinics and regular people but don't shut the regular people out just because they don't spend thousands of dollars to get a plaque on the wall. May-22-2011

Against I am in complete opposition to this bill SB412 and AB289. I am a Licensed Massage Therapist in NV, a Licensed Massage Therapist in Missouri, hold an Inactive Massage Therapist License in UT, and a Licensed Massage Practitioner in Washington (State). I am on the faculty of the Northwest Academy of Healing Arts in Tacoma and have a very good background in my field and in some other complementary integrative modalities as well. I spent 20 years in the USAF and retired in 1994 as a Lt. Colonel. I have been professionally trained as a Counselor and have a Master's Degree with a double major in Human Relations Psychology and Business Administration from Webster University in St. Louis, MO. In addition to my formal university degree training, I have invested several years and over $100,000 becoming educated as a 'bodyworker' which included training in Acupuncture, Nutrition, Massage Therapy, training as a Chiropractic Paraprofessional from Logan College of Chiropractic in St. Louis, MO, and a specialty of CranioSacral Therapy by the Upledger Institute in Palm Beach, FL. I'm not some uneducated and uninformed person off the street that has no idea what I am talking about! Since I am licensed by the NV State Board of Massage, the bills don't impact me severely; however, I can see hundreds of competent and well qualified individuals being put out of business and losing their livelihoods because of this bill. The loss to the public will be staggering. I can foresee that it will cause a large number of people to give up on Nevada as a place that they want to live & have already heard a few people state that if this law is passed, they will have no choice but to move to a new state and give up on Nevada as a good place to live! We have a shortage of competent medical people in this state already and many of the great ones have given up and moved away because of the high cost of liability insurance for their professions. Against I attended a meeting on 5/18/11 to support OPPOSITION to this bill. It seems to me that the claims of innocent intention on the part of the sponsors are not entirely truthful. The bill is confusing even after several amendments have been made. Start from scratch and be straightforward in crafting the bill. Also, I don't believe that prosecuting and imprisoning felons will be without cost to the state. I looked at the fiscal impact statements, and if the scope of the bill is as 'without limitation' as its own wording states (despite the protests of the sponsors), then there is the potential for a lot of people to be accused of a felony for practicing complementary therapies that help people. Also, if they are simply wanting to change the name of the board, then choose a name that is more specifically appropriate to the type of people that will be regulated by the board. This bill is written in such a way that it feels like purposeful deception is being practiced in order to open the door for the board to claim whatever power it wants. I heard yesterday that it only applies to people who are currently licensed under 630A, and that you can't even apply for a license unless you are licensed under 630A. What about people who are NOT licensed under 630A. It does not say they will be left alone. People play with words to hide their true intentions. It feels like that is happening here. It should be easy to write a bill that is straightforward if your intentions are straightforward. Please vote NO on SB412 May-19-2011

Against Citizens should have some autonomy over there body, health and what works best for them. I agree there are a lot of "cures" that are not on the level. The nuiances of the body and maintaining optimum health are complex. We don't need Nevada legislature interfering in our decision making process on who one can talk to about nutrition, or other complimentary health modalities. Against Dear Representatives, Along with many others in Nevada, I believe prevention is our best medicine, but when necessary I turn to alternative medicine and therapies. With the rise in cost of living, unemployment, health insurance and health care, I depend more than ever before on these modalities. Not only do they work, but they are less costly. I have grave concerns about this SB 412 shutting out unlicensed practitioners and those with small alternative practices, thus impinging upon the People's freedom to choose when it come to their health. These are my observations of this bill: 1. It is not spelled out which practitioners would be included or exempt from licensing. I STRONGLY SUPPORT A SAFE HARBOR EXEMPTION FOR THOSE WHO ARE UNLICENSED. 2. It appears too much is left to the Board, for example the power to deem a license holder of "good moral character." Is that possible, let along legal? 3. The cost of fees and mandatory licenses may be prohibitive to those with small practices and even put them out of practice and business. 3. If authorization to "prescribe and possess dangerous drugs" is one reason some homeopaths support this bill, couldn't the existing legislation be amended to reflect that needed change. Bottom line, the language of the bill is so obtuse it lends itself to interpretation at will, the Board's purview left wide open. The people of Nevada would be left powerless in it's wake, their health care choices significantly reduced. The same comment could be made about AB 289. As the people are being forced to do in the face of our current economy, would you also do your best to do more with less. Nevada is a state of proud, rugged individualist. Please honor our right to choose. Say NO to this bill, or give us a bill that we can live with that does not cost us our health and insures free choice int he future. May-17-2011

Against This is bill should not include unlicensed natural health practitioners such as herbalists, and nutritional consultants- this bill focuses on physcians and was originally a homeopathic bill- it should be limited to physicians and homeopaths. Practitioners do not have "patients", nor do they prescribe nor are they involved in "medicine" which implies allopathic medicine. You could not possibly license all the many types of practitioners in a fair and open manner. You could not have an exam- as there are too many different types of practitioners to test- Charging practitioners $300 per year is outarageous- to be fair you would have to cut that in half- and not require an exam, and accept any practitioner who has completed a training program. It would be much better to exclude all unlicensed practitioners by adopting the proposed amendment from Jim Jenks. The board proposed in this law consists of 3 physicians trained in allopathic medicine- this board should consist mainly of natural health practitioners since it is about licensing these practices and should only have one allopathically trained physician, with 2 practioners- the current law does not allow for any practitioners to be on the board! Against My name is Mitzi Reed and I have lived in Nevada for 13 years and my husband has lived here all his life. I founded a holistic organization in 2006 that represents over 1,000 practitioners here in Las Vegas alone. I am very well connected in the holistic community and have a database of over 5,000 local people whom most are very health oriented. I am against this bill because we are already Federally regulated and it is our Constitutional right to have freedom of association. This will hurt our local economy, and will hurt the health of many people who have turned to this type of healing. Also, I come from a corporate background and now do holistic coaching and marketing and often recommend to my clients various resources that may help them and should be free to do so and they should be free to choose to accept my recommendations or not as again that is our Constitutional right to have freedom of association. If this bill passes, it will restrict our freedom of choice. It does not guarantee us our health and well being by using a state regulated service. This is a burdensome and costly measure that is not needed or wanted. I also want to state that I was appalled at the committee’s behavior on May 11th AB 289 hearing, especially Senator Schneider’s behavior. We deserve to have our concerns be heard. You work for us, and are voted in because we trust that you will vote for what the majority of the people want. We have legitimate concerns about this bill and you should be open minded to hear those concerns. Against Who is backing this bill; certainly not the people!? It is the pharmaceutical companies that are driving up the cost of medicine and what doctors charge to see us. Pharmaceutical drugs have side affects which begat more drugs for those side affects and so on. Some natural ways to take care of one's self is through knowledge of your own body and what it needs to relax or heal. If massage, Reiki, herbs, or aromatherapy work, live it be. It shouldn't have to be against the law to do something natural that doesn't involve drugs. Chiropractors can and are very good at what they do and have helped me be pain free and mobile without drugs or surgery. SB 412 violates a basic principle of professional licensing: The requirements to obtain a license should match the knowledge needed to practice the profession. SB 412 invents a very broadly defined field called "complementary integrative medicine" which does not actually exist as a unified profession. As written, it encompasses dozens of widely varying practices that use different methods and are taught in different ways. Most of these are not medical in nature and not taught in medical schools. They have their own training and certification systems. Yet SB412 requires all licensees to be Medical or Osteopathic Doctors and does not require them to have practitioner level training in any of the other non-medical practices covered by this license. There could be doctors licensed as MD (CIM) who have the right to practice something for which they are not qualified. There is no further standard they must meet to practice Reiki, Polarity, Qi Gong or any other alternative practice. At the same time, those who are actually trained in such things, but are not conventional doctors, are prohibited from practicing. A license from the State is an assurance, to the consumer, that the licensee is a qualified practitioner of the profession. This bill creates a misleading designation- Complementary Integrative Physician- and violates the stated purpose of this bill (Section 3-1 & 2): Sec. 3. The Legislature hereby finds and declares that: 1. A person has the freedom of choice with respect to obtaining health care in this State. 2. The State is responsible for ensuring that competent persons practice alternative and complementary integrative medicine SB412 is a poor adaption of a bill from the 1980s designed to regulate one profession. Against I just learned that this bill was introduced by a homeopathic doctor. I also learned that his original intent was to allow homeopaths to practice without requiring that they be an MD. This is a great intent. I feel a better way to approach this is to change the NRS for the homeopathic board as it already exists. Against I do not think this benefits our freedom of choice. Our choice to believe in what we each humanly feel comfortable with as well as in having HOPE is being challenged; averted. Freedom of speech and freedom of religion is about our own sanctuary - our human body that is an individual God-given right. Many have used integrative medicine for years which limits us from even using our "ancient remedies" that our forefathers, our ancient decent (Hawaiian culture) that is a part of me or other individuals who were raised with practices that has been used for years. Reiki and other energy work is non-intrusive, wellness practices of one's well-being is non-intrusive...IT gives hope and more so it is something so private, yet comforting to one who is in pain or dealing with a way to heal. At a time of healing the pain, this is private --- not for the government to dictate how one should comfortably or should choose to seek medical attention. This is taking away our rights as human beings. Against I was just informed of the details of SB 412 and I urge you to vote no on this bill. I am a trained Reiki practitioner in southern Nevada. Let me outline how my services help people and how this bill would damage our community. I volunteer my services as a Reiki practitioner at The Caring Place, a non-profit organization that provides free complementary care to people whose lives are touched by cancer. In case you don't know, Reiki is a non-invasive, energy-healing technique. When people come in for the first time, I tell them that my goal is for them to have a restful and relaxing experience. I ask them to make their best effort to relax and calm themselves, and often people fall asleep during the session and feel rejuvenated and revitalized when it is finished. The reason I started volunteering my services was due to a conversation with a friend who is a participant at The Caring Place and receives regular Reiki treatments. She told me that Reiki helps her sleep better, it helps reduce her pain and helps her maintain a positive attitude as she battles with a particularly aggressive form of cancer. I have two concerns about this bill. 1. Right now organizations such as The Caring Place are able to offer lots of complimentary care services at no cost to those who are very much in need of these services. Especially for many folks diagnosed with cancer, money to pay for these kind of treatments is difficult to come by. Many have to quit their jobs while they undergo chemotherapy and have a very difficult time financing their healthcare, let alone complementary care services. If this bill were to go into effect, there is no indication how much licensing would cost and what it would require on the part of the practitioner or how that would affect the ability of organizations to provide services to those in need at little or no cost. The language in the bill is so vague about the costs of licensing and I believe that alone is reason enough to vote no. 2. It does no Apr-19-2011

This bill would take away the rights of all citizens to access any type of alternative medicine; which includes massage therapy, craniosacral therapy (now regulated by massage), hands-on healing (such as reiki or therapeutic touch), naturopathic medicine (which encompasses wellness programs of eating, exercise, nutritonal supplementation) etc. It is very disturbing to think that the only type of healthcare available will be from allopathic medical doctors when there is already a shortage of these people, with healthcare not easily accessible. Please consider our rights to clearly make our own decisions, this bill would eliminate the ability of many to provide services which we have educated ourselves in. Against I am against this bill because their are many people practicing complementary and/or alternative therapies that have no interest or desire "to prescribe or possess dangerous drugs and controlled substances". Their is no doubt that the proposed Board of Complementary Integrative Medicine would create requirements for licensing that would be inapplicable and inappropriate for many complemtary and/or alternative therapy practioners, e.g., homeopaths, naturopaths, massage therapists, herbalists, chiropractors, etc. If this bill would be applicable only to those that can already prescribe or possess dangerous drugs and controlled substances, i.e., M.D.'s and D.O.'s, then I don't see any harm in it. However, it should not encompass anyone that currently is not allowed to prescribe prescription drugs and controlled substances. Thank you. Apr-16-2011

Against I do agree that there must be a level of competency for a person to "prescribe" a form of treatment. Where I disagree is that a blanket bill be enforced. To suggest fresh air and exercise is not dangerous to any human being where as prescribing mega supplements may be. There is such a variety of homeopathic modalities. Against Fiscally Speaking this is not the time or the place for implementing new boards of regulation. This law will call for somekind of budgetary support at a time when we don't have enough in the coffers for very basic and necessary programs. It will impact jobs and companies such as VRP who pay tax and bring business to Nevada. It is unnecessary! Far more patients are impacted negatively by common over the counter medicines than are affected adversly by natural suppliments, naturopaths, etc. Licensure and AMA endorcements don't mean better care!! I know this from personal experiences, and hundreds of thousands like me who are making the move to alternative medicine share this view. This bill only beneficial to Mr. Royal and others like him who seek to limit healthy competition within the this effective and popular trend in integrative health. In addition, your constituents have a right to eat what they want to care for themselves and their families. They have the right to share their opinions and experiences. They have the right to seek the knowledge, opinions, products that they feel will benefit them. Moving to criminalize these things is simply criminal itself! SB412 encroaches on our rights as reasonable, responsible, educated people, and for some, even upon their religious views. For that reason, I feel this is in violation of our right to pursue (health) and happiness. Lastly, todays' motion to move to a "work session", was viewed to be a tactic to thin the opposition to the bill, and comments/attitude made by one Senator - one ELECTED by those he spoke down to - who had patiently waited for their protected right to speak, were unconscionable!! Against For natural health therapies that are not harmful or risky to the public, it is not good to do licensure, which sets up turf battles. Better to do safe harbor legislation, which NM recently passed and 7 other states - twenty more are in process.
