Against This bill circumvents the law passed by a majority of Nevada to support an ever decreasing (dying) percentage of our population. The data showing how it has hurt taverns is flawed and heavily influenced by the general economy. Should the majority of Nevadans who would like to have a drink and meal be able to do so without a side of smoke? We sued the tobacco comnpanies because of the cost to health care caused by smoking but we are willing to look the other way when it comes to this? Governor Sandoval please veto this bill. Against Do not weaken the Nevada Clean Indoor Air Act! As a nurse caring for people with lung disease on a regular basis, I object to contributing to a disease process that is 100% preventable! The people of Nevada were very clear about wanting clean air when we voted the original bill in. If this government is truly of the people, by the people, and for the people...then leave this bill alone!!! We want clean air!!! For People who voted to eliminate smoking in certain establishments, most likely never frequent them. This has hurt businesses in our community. Many taverns offer food, which certainly should be offered to people who have been drinking. Many taverns are also frequented by a "regular neighborhood crowd." Against Please vote no on AB571. Tobacco companies artificially increase the levels of nicotine in cigarettes to intensify the levels of a users' addiction. Tobacco companies also put some 599 possible additives into their cigarettes,all of which are approved for use by the U.S. Government. When these ingredients are burned, they produce approximately 4,000 different chemical compounds and at least 400 toxic substances that we all INHALE with every breath of smoke. Just to name a few Ammonia, Lead, Butane ,Acetone, Formaldehyde, Hydrogen, Cyanide and so on.This is what other people choose to do to us because no one is stopping them.. I do not care how old(under or over 21) a person is,no one should be allowed to kill me with thier disgusting habit.I am begging the Senators to make the right choice and vote against this bill. We are all watching and taking notes to see if you want to override the public's clean indoor air act.I am a service worker who has worked in bars and casinos my whole life. . . Against I'm very disappointed that this has passed the Assembly, and I implore the Senate to stand by the voters' decision on this issue. I reject the notion that the law is the sole reason for a decline in revenues; business owners conveniently ignore the fact that the law passed at the beginning of our nation's economic crisis (in which Nevada was particularly hard hit). It is unreasonable that non-smokers, children and employees of these establishments should be exposed to the second-hand smoke of the minority. I am a former smoker, and I do believe that people have a right to smoke. Smoking is not necessary for survival, however; if you choose to do it, you should exercise your right in a way that doesn't put others at risk. There is plenty of documentation to demonstrate the significant health risks of second-hand smoke; it's more than an inconvenience. If there are other issues related to the original law that are unfairly impacting some businesses, then I suggest we find another way to level the playing field. The solution cannot be to increase the health risk to all Nevadans. Jun-06-2011

For I, along with 2 partners, own two small neighborhood saloons. As you know, the smoking ban has had a very adverse effect on our business. To allow smoking, we made the decision to close the kitchens. We basically felt this was the lessor of two evils. We have never allowed minors in either establishment. I believe a person 21 years or older should be able to make their own decision as to whether they want to eat in an establishment that allows smoking. I do not feel a bar is an appropriate enviroment for minors. Food will also help us keep people from getting behind the wheel when they are hungry but do not have the option to eat in our establishment. Please see the Alcohol Awareness classes we all are required to attend. Please consider lifting the cigarette ban in bars that do not allow minors. Jun-06-2011

Against I would like to thank: Assemblywoman Debbie Smith Assemblywoman April Mastroluca Assemblyman David Bobzien Assemblyman Paul Aizley Assemblyman Kelvin Atkinson for voting no to AB 571. I will remember who to vote for next time and tell others to do so. They respect the will of the voters and do not cave to bribery or pressure to the wring thing for the health and welfare of the people of Nevada. They are also voting to protect our tax dollars. Nevada taxpayers pay for health care for tobacco related illness. All others I will make sure to let family and friends to know not to vote for them as they have no regard for the will of the voters but rather do waht they want to do regardless of the will of the voters, or the health and welfare of thousands of Nevadans. These legislators are short sighted and have exercised poor judgement in my opinion in supporting any tobacco use period. In addition to that, their poor decision could cost Nevadans millions in medical expenses. It is proven that second hand smoke causes heart and lung disease. Really, if they just read the paper here in Vegas, the Las Vegas Review Sun ran an article on it. If they listened to the news, Channel 8 also had great coverage of workers who never smoked who became very ill from exposure to second hand smoke. The numbers speak for themselves. Really, it is not rocket science here. Very disappointing. I will not be long in a state that does not promote the Preamble of the Constution or Bill of Rights. For Aside from the devistating effect that this has had on the tavern business, the majority of which are small neighborhood businesses, and the effect of puttting so many people out of work. The original bill was written to make people believe that there neighborhood taverns would not be affected as casino's were not affected. Against Once again the legislature has "caved" and started the process to further erode the Nevada Clean Indoor Air Act. This bill, if passed will overturn the will of the people, just like what happened at the end of the 2009 legislative session. Are voters to assume from this that their votes are worthless? It would seem so. There is NO safe level of 2nd hand smoke - Period. The level of carcinogens in a smoke-filled tavern, casino, any room are enough to begin the DNA damage that can lead to devastating cancers and other smoking related diseases. It is beyond me, a long-time cancer nurse, that persons charged with representing the citizens of Nevada would be convinced by the smoke-and-mirror tactics of the tavern owners and lobbyists that any part of AB 571 is good for the state. "Revising" the existing law? Give me a break. It has been proven that the NCIAA did not cause the economical woes that the tavern owners are complaining about. EVERYONE in Nevada is affected by the economy. What about people looking for jobs and literally have to take a job in a smoke-filled environment? Some will have no choice. You will be putting them in harms way, literally. PLEASE OPPOSE AB 571 IN TOTAL. Show the voters who put you in office that you respect our call for a healthier Nevada. Please OPPOSE AB 571. Smoking tobacco is not prohibited in: 16 (a) Areas within casinos where loitering by minors is already 17 prohibited by state law pursuant to NRS 463.350; 18 (b) Stand-alone bars, taverns and saloons [;] and age-restricted 19 stand-alone bars, taverns and saloons; 20 (c) Strip clubs or brothels; 21 (d) Retail tobacco stores; and 22 (e) Private residences, including private residences which may 23 serve as an office workplace, except if used as a child care, an adult 24 day care or a health care facility . OK-Do you see where it CURRENTLY says it is NOT prohibited! The only line that changes in AB 571 is "age restricted" stand alone bars. Come on people-They are not making Applebees a smoking restaurant and bar....because it is NOT currently ALLOWED there to begin with. It seems evidant that those wanting this amended and passed as such wrote it to meet their needs and to be so confusing that nobody can understand what it now says. Against Why should we the people who voted for NO smoking in restaurants, bars, taverns, casinos, etc., where food is being served, why should we now be forced to be at the mercy of the legislature voting to reverse the previous decision, one that we the people voted FOR in the first place. It is incomprehensible that the legislature should even entertain reversing what the majority of the people wanted -- namely no smoking in those facilities. The majority of the people of Nevada should have the right to have that vote upheld, and we should be able to trust our state government to uphold the people's decision. Against I work at a Travern. I will not say the name of the place becuse I would get fired. Please do not vote for ab571. I have worked here for 4 years in a smokefree work place. I would have to quit because I get really ill around smoke. Times are hard and people can not afford health insurance. Against My father died of lung cancer when he was 48 years old. He worked as a bartener for 26 years. He never smoked his whole life. His Dr. told our family and him that it was from working all those years in smoke. I wish that we would have had the smokefree laws that we do now then. He died 10 years ago. My dad never got to meet his two grandsons. Even sadden they never got to enjoy him. He was the most wonderful funny happy dad a girl could ever ask for.I beg of you to vote no on AB571. Jun-05-2011

Against Please vote No on ab571 I was a smoker and I quit because I could no longer smoke at work!! I am a bartender. The clean indoor air act was the best thing that happened for me. I have other friend who have done the same thing. If the ban on amoking is lifted I will be subjected to second hand smoke again after 6 years of not breathing it!! The first month or so I may have lost a few bucks in tips. Let me tell you, that I am making good money and my life is so much more Healthy. Thank you for your time. Against I would think that in Nevada about one person out of 6000 people might own a bar. That means that if you pass this law you are going againt most of the other 5500 whom will be subjected to secondhand smoke. Those are the people whom you represent!!! We all voted for the clean indoor act. The Bar onwers do not hang out in their bar.. The employees and customers do. Please do not go back 6 years and allow smoking!!! My ETS and Buildings - A Design Guide suggests a maximum dose of 9 cigarettes/year in smoking areas of offices, and 2-1/2 cigarettes/year based on 300 hours in restaurants. For As a bartender at a small tavern that use to be able to serve food, I cannot tell you how not being able to serve food has severely hurt our business overall. We can barely keep our doors open as customers want to be able to drink, smoke, game and eat. Having establishments that allow for this helps stimulate the economy and provide jobs. I agree that people should be given the option to choose if they want to be subjected to smoke or not while dining or drinking. However, the key word here is "Option". If they choose not to be around smoke than they are "free" to dine at a restaurant or at an establishment that chooses to be smoke free. Against Throughout the process in the Ways and Means Committee, the bar and tavern owners were able to pretend that they were the authority regarding the NCIAA and its enforcement. They were able to dictate the direction of the amendments offered, and while they appeared to compromise, they presented language that did not address our major concern of the expansion of smoking and exposure to secondhand smoke, and leaves us with changes to the law that remain unenforceable. The bottom line is that this bill still weakens the clean indoor air act, and it should be stopped. Please stand up for the concerned citizens, and take a stance against this bill. Ok with me on the proposed new words on page 5 lines 33-39, to support potential of business promotion including "e) The area of a convention facility in which a meeting or LINE 34 trade show is being held, during the time the meeting or trade LINE 35 show is occurring, if the meeting or trade show: LINE 36 (1) Is not open to the public; LINE 37 (2) Is being produced or organized by a business relating to, LINE 38 tobacco or a professional association for convenience stores; and. . ." There is not one business—a casino or a tavern—that can prevent a customer from bringing into the establishment a child due to no tavern police powers. Tavern owners complaining about business should look at NV population decrease & no work for people to blame in business reduction rather than customers wanting to smoke as the reason affecting tavern business. On 5/29/11, I sat in a row of 9 people at church. Every person but me is out of work. That is the reason there is no business – there is no work NOT the lack of ability to smoke in a tavern. For Most of the Pubs we go to in town have gotten much better about the ventilation and they have separate areas for people that want to sit and eat. They have the systems set so that any cigarette smoke will be blown away from those areas. Also, the Pubs we go to have forbidden smoking cigars. This is Las Vegas, a town that was built on allowing visitors and residents to enjoy the freedoms that other states deny. The tourists should not even be chiming in because they only visit the casino properties, which have always allowed smoking….and I bet the majority of those voting AGAINST are from other, failing, bankrupt states. You moved here to reap the rewards of our success but now you are trying to ruin our state. Against optimize a safe environment for eating/socializing. Historically if folks want to just drink...let them be exposed to the dangers of 2nd hand smoke. BUt make it feasible if folks want to drink, they can go to an eatery with alcohol and enjoy drinking and socializing without tobacco exposure. Those that want/need to use tobacco have a site (the bar) where hours could be spent. THey should be able to leave tobacco a few minutes to eat. THen back to the bar. Against I am fighting my 3rd round of Cancer from Secondhand smoke. I have also had my Voice box removed and can't talk without using a machine. I did not know secondhand smoke was so bad and I got my cancer from the people I worked with, my friends and family.I said go ahead and smoke it won't brother me. WRONG. If you allow them to serve food in smoking bars, a smoker my tell his wife lets go out and eat with the guys, she is pregnant, She don't know that Secondhand smoke will destroy her and the Baby health and mybe kill her new baby. a lot of people don't know how bad Secondhand smoke is for them and their baby, so they don't know to stay away from it. Over 50,000 people die each year from Secondhand smoke. A lot of smokers don't know they are killing their family and friend. Please don't allow a them to create a trap. For The way the bill is currently written it only eliminates people from eating, not from smoking. It should be the right of bar owners to determine how to run their businesses. If they feel that it is more profitable to allow smoking they should allow it. If they feel that is is more profitable to ban smoking they should ban it. It should be their choice. However, I do not agree that the ban should have included bars and taverns. I don't know about anyone else, but I do not take my child to a BAR. I work in bars every day and I do not see childern in them. I see adults, of which should be able to deside for themself, not having the government deside for them. For I have been in the food and beverage business here in Las Vegas for 7 years. When the smoking ban was instituted in 2006 I saw a lot of bars and restaurants go out of business (and this was when the economy was good). I also saw a lot of taverns close their kitchens so they could keep their gaming customers resulting in the termination of kitchen and dining room staff. Against Nevada needs to toughen up smoking restrictions, not loosen them. Second hand smoke kills. Just read the Surgeon General's report. About 75% of Americans are non-smokers. In a democratic society we need to cater to the majority, especially in cases where the majority are for a healthier option that saves lives. Not only does strengthening smoking restrictions help non-smokers, but it also increases cessation rates for smokers. We need to shift public opinion on cigarette smoking in Nevada. The general reaction to someone smoking in public should be similar to someone spitting in public. I am sick of being forced to breathe toxic chemicals when it could be stopped by following the lead of most other countries and states. For Dear Nevada Legislator: This letter is written to express the support of the proposed amendment to the Nevada Clean Indoor Air Act, NRS 202.2483 ("NCIAA), which is currently before you this session. In 2006 when the NCIAA was voted on by the general public , the petition on which the ballot question was based stated, "This Act shall be known, cited and referred to as the "Nevada Clean Indoor Air Act: Protecting children and families from secondhand smoke in most public places, excluding stand-alone bars and gaming areas of casinos". In the preamble to the Act itself it states that smoking is allowed in bars. What the Act did was to eliminate food from the smoking areas of taverns. We would argue that the majority of people voting in favor did not understand that consequence. The Bill before you today simply seeks to reinstate food service in areas of bars where smoking is already legal and was approved by the voters as such in 2006. The affect of the smoking ban, coupled with the recession close on its heels, has devastated the Nevada tavern industry. This proposed legislation will attempt to help out the small business owners who operate the majority of taverns in Nevada. It will also allow us to put Nevadans back to work, by allowing locations which chose to close their kitchens rather than have their patrons stop smoking, to re-open those kitchens and bring additional staff on. This constituent would urge you to pass the proposed amendment to the NCIAA, which continues to protect children from secondhand smoke, helps create jobs and does not expand smoking beyond areas which it is already allowed. For We do not need more governmental interference in our lives. Any person who is not yet aware of the harmful effects of smoking to both themselves and others has his head in the sand. Yet, our air, water, food, clothing, and general environment all contain carcinogens and other harmful elements, but the effects are not advertised as the smoking issues are. Bars, taverns and saloons are already governed to prohibit the presence of children. There are abundant options for any adult who wishes to avoid the atmosphere of cigarette smoke. The current prohibition of smoking in bars that serve food is completely unnecessary and extremely deterimental to the related businesses. Non-smokers have their rights, granted; but smokers also have rights. In this case, I feel that non-smokers are actually the minority as far as insisting that, because they may wish to patronize a particular bar, everyone else at that bar should refrain from smoking in their presence. For It makes sense to have food readily available for people over 21 who are drinking alcoholic beverages. However, the current law prohibits over 21 patrons from eating in a tavern where food is served if there is smoking present. It does allow patrons (where minors can be present) to smoke and drink in taverns that do not serve food. What’s the connection? It also allows certain taverns and all casinos to serve food where smoking is present. Minors can and are present in these establishments. Because the law only applies to some taverns, it financially penalizes those establishments with a competitive disadvantage. May-27-2011

For A business owner should be able to decide the types of clientele that he does not mind servicing. If a person going to said bar/restaurant doesn't like smoking then they don't have to go there; nobody is forcing them to go there. If enough bars/restaurants become pro-smoking and there are many nonsmokers who don't have many options left as to where to out for dinner or a drink then they are free to open up a non-smoking restaurant/bar is they'd like. The few people left who are ONLY non-smoking will do great business. This being said there is no reason to fear the bars who want to allow smoking. Though I agree that it 'could' be considered bad if people 'have to' work in an establishment with lots of smoking. If this is the concern then make the applicant sign a waver before they get the job identifying themselves as either a smoker (in which case they shouldn't mind) or as someone who accepts the risks associated with working in an environment with smoking. I have a chronic health condition that is exacerbated by exposure to smoke. For The bill was originally introduced to prevent children from breathing smoke. I believe that children should not be exposed to smoke. Taverns that allow only patrons over the age of 21 should be able to have smoking if they choose. The patron then has the choice to frequent an establishment that has smoking or not. As to the issue of the employee’s being exposed to smoke, they have the same choice to make as the guest does, if they do not choose to work in a smoking environment then they can choose another line of work or locations that remain smoke free. It is all about choices, and people over 21 should be left to make those choices for themselves, not forced to bend to the opinions of others. If you don't like the smoke, don't go in the establishment. That is the opinion that will dictate what tavern owners do. For The nciaa was disenguously sold to the public. It was sold as a bill to protect the children but it only protects casinos. I am a tavern/restaurant owner with three locations. I invested several million dollars into my business assuming a certain business model: food, liquor, and gaming. The nciaa forces people like me to choose between food and gaming, and the businesses absolutely do not pencil without gaming. Therefore, the effect of the nciaa on taverns has been devastating. At one location I've closed my kitchen, and at the others we have had to lay off staff. All three of my locations have suffered losses in net cash flow of between $10 and 20 thousand per location per month. This is a bad law that needs to be repealed. May-26-2011

Assembly Bill 571 is just righting a wrong, because taverns should have been afforded the same exemption as Casinos in the Nevada Clean Indoor Air Act, which permits smoking in areas where loitering by minors is already prohibited by state law per NRS 463.350 (i.e. Gaming establishments). AB#571 only strengthens and clarifies the current law by creating "age restricted bars and taverns" (21 and older) where these establishments can serve cheeseburgers and chicken fingers - where SMOKING IS ALREADY COMPLIANT WITH THE LAW!!! I have been in many restaurants in California which are doing quite well despite their more extensive bans. Their business failures are more likely due to the local economy or other factors unrelated to this ban. They state the ban was originally intended to help families and children. Consider the mother who works as a waitress and is forced to breathe in second hand smoke. We KNOW cigarettes are deadly...we KNOW secondhand smoke is deadly. Above personal choice should be the right to be able to work in a healthy environment. We don't let people work in asbestos contaminated buildings. We have so many safety laws and regulations for the health and safety of workers.. Why would we allow bar and restaurant workers to be exposed to these contaminants? Or will MY children be forced to pay for that? Smoking is a personal choice but the effects are far reaching and can be seen for decades. My life has been greatly impacted by smoking, even though I don't smoke. My mother suffered for 4 long years due to a smoking related illness before she finally died on my 23rd birthday. My brother and father both also died from smoking related illness. Even beyond the damage of secondhand smoke, families and lives are damaged in countless other ways by smoking related deaths. Revising the law to allow owners to decide whether or not to cater to smoking customers gives everyone a choice and doesn't unilaterally force everyone to bend to the wants and needs of some over others. CLEAN INDOOR AIR BOOSTS THE ECONOMY. WHEN A PERSON IS SMOKING, THE SMOKE THAT COMES OUT OF THE OTHER SIDE OF THEIR CIGARETTE IS CALLED SECOND-HAND SMOKE. THIS SMOKE IS SIGNIFICANTLY MORE HARMFUL THAN THE SMOKE A PERSON INHALES WHILE SMOKING, MAINLY BECAUSE THE OTHER SIDE HAS A FILTER ON IT. Nevada voters were strongly in favor of implementing these new regulations, with an eight-to-one margin of voters stating they believe Nevada’s customers and employees have the right to breathe clean air. Against I can't believe that our government would even consider passing a bill that once again will allow others the right to smoke in an establishment because it has a bar. Second hand smoke KILLS people. It's a Fact and there is no two ways around that. By passing a bill to allow smoking in a bar you are allowing smokers to slowly kill those that don't smoke. Figure it out people. I enjoy many restaurants (and many of those have bars in them) because for once I can actually taste the food (instead of ashtray smoke). Stop protecting the rights of those that choose to kill themselves smoking (as well as others) and start protecting the rights of those that choose to be healthy and alive. May-24-2011

Against All people have the right to be able to enter a food establishment. Those allergic to smoke -- for instance, those with asthma -- would not be able to frequent places where smoking is allowed. In my opinion, this is a form of discrimination against those with such health problems, and my family would be no longer interested in living here if such a bill were passed. Against I don't understand how this does not expand the number of places where people are exposed to secondhand smoke. Many of the taverns that have selected to not allow smoking in order to keep their kitchens will now be able to allow smoking -most likely significantly increasing the number of venues where people are exposed to secondhand smoke. That is expansion which weakens the law that I voted for. Please do not accept the self-serving statements that the proponents offered this morning that it does not expand smoking - it clearly will. For As a frequent visitor to Las Vegas we went from spending about $100/day on food in sit down establishments to spending about $20/day on fast food due to the smoking prohibition. Passage of this bill would definitely bring us back into bars, saloons, and taverns and establishments that serve food. May-23-2011

Against I am solidly against this bill because it represents an effort by businesses to circumvent a voter-enacted piece of public health legislation. This bill is about sacrificing the long term health of the general public and tavern employees for the sake of the base pursuit of additional profit on the part of business owners. With the economy being as bad as it is many people who work in taverns will not feel like they can quit their jobs just because the tavern they work in allows smoking. However, those workers will be the ones who pay the price down the road when they develop cancer and are bankrupted by medical bills and the tavern owners are pocketing the profits and retiring without a care in the world. Against Please do not allow smoking in food serving establishments. I am the Mother of a young son who has bronchio pulminary displasia. We struggled for years to be able to go into a bowling alley, restaurant or many other places because of all the smoke. We found ourselves to be very limited in the places we could go as a family. Once smoking was banned from establishments that served food, we were able to enjoy so many activities that we had missed out on previously because of not being able to expose our son to the cigarrette smoke. We were able to go places that "normal" families enjoy, places we just could not even enter before. Tobacco smoke can trigger severe asthma attacks in children and adults. Please do not pass this bill. It will have a ripple effect that will seriously limit what families are able to do. People should quit smoking. The economy is very bad for everyone, I do not believe one bit that bars, taverns etc. business is hurt because of not being allowed to smoke. There is no direct evidence to support that claim. Against As a parent of a 2 year old who suffers from asthma, I vehemently oppose this bill. You cannot segregate smoke by doors and signs...it leakes through cracks and through ventilation systems. My daughter's asthma has been triggered in the car at stoplights next to others smoking in their cars. That is how sensitive most asthmatics can be! Unfortunately, those with emphysema, COPD and lung cancer don’t have enough lung capacity to take a deep breath. The evidence is overwhelming about the effects of second hand smoke—it is lethal. My father died of lung cancer because he had smoked since he was a teenager. Against I strongly oppose AB 571. I worked very hard with many volunteers to pass the smoking ban in 2006. 83% of Nevadans support the Nevada Clean Indoor Air Act (2011 survey). Nevada voters want more protection from secondhand smoke, not less. Do not weaken the smoking ban. OPPOSE SB571. Nevada's smoking ban has already resulted in a significant reduction in heart attacks and strokes. This means that the smoking ban saved Nevada many millions of dollars: An average $34 million annual reduction in hospital charges, and an average $14 million annual reduction in Medicare and Medicade charges. If you allow smoking to take place in bars and taverns that serve food, you will essentially be allowing smoking to occur in eating establishments "aka"restaurants. If you allow bars and taverns that serve food to allow smoking you will be opening the doors to allow smoking to come back into other public places. Against we wanted this, we voted for it. The argument that they are loosing money because of it, doesn't work with an increase in the number of new businesses and the economy. I hate smelling like smoke if I came to eat. May-20-2011
Against This was a voter enacted bill. How can you work to roll back part of the NCIAA against the will of the people? It certainly seems like a deal was made behind closed doors as Clark Clark elected officals publicly stated back in April. Against As a veteran of the US Marine Corps and Navy Reserves I implore you not to weaken the voter approved NV Clean Indoor Air Act. I voted for the smoking ban and no part of it should be undone. Do not let smoking in bars aka bar restaurants. The public and workers should not have to be exposed to more smoke. I know exactly what I voted for and would be outraged if the legislature believed the lies of the bar and taverns.
