Against This is just a way to allow insurance companies to regulate the tutors implementing the programs that professionals are coordinating with them, and they are already licensed. I feel this will hurt families who are desperately trying to help their children with therapy, which already can cost them $50,000 per year, to pay even more for someone who can be licensed. Against This bill would take away ABA therapy to all childern in NV. First of all there are not enough qualified therapists in NV, I believe about 17. Second even if there were enough qualified therapists the cost would be unattainable. They would charge a minimum of $100 per hour. My program currently reimburses $10 per hour. I would not be able to afford the additional $90 per hour and I don't think anyone else would be able. Feb-19-2011

Against I believe this bill will do far more harm than good. Nevada simply does not have enough interventionists with the proper degree to meet the high demand for help. Many are seeking degrees in other areas but still are valuable and more than qualified to continue working as an interventionist. While a great deal of compassion, kindness, and caring is necessary to work with individuals with autism, those characteristics do not sufficiently ensure high quality behavioral treatment. With appropriate treatment, individuals with autism can make tremendous progress, and approximately 50% are considered recovered after completing an ABA treatment program. Against AB65 has major language issue, I believe the way the AB65 reads, all those practicing Applied Behavior Analysis (ABA) will have to be licensed and certified, this will limit its use in state funded programs, education classrooms, early intervention programs, and increase cost. Thousands of people's quality of life and functional abilities have been greatly improved already, however, with the passing of this bill as it currently reads will negatively impact those families and individuals. I received a Master of Science Degree with an emphasis in applied behavior analysis and autism from the Sage Colleges. There are not enough licensable practitioners for all of Nevada's other behavior annalysis service needs. Against Historically, ABAI has not been the accrediting board for Behavior Analysts. That has came from the BACB board. Many of us practitioners especially in southern Nevada have taken the courses for the BCBA certification from UNLV, a state inistitution of Nevada. If this law passes as is, many people that are still enrolled in the UNLV program will not be allowed to use their certification. UNLV is certified by the BACB. Against Why is the Board of Psychological Examiners involved? By their own admission they don’t understand these services. AZ just passed the insurance mandate and left it up to the Behavior Analyst Certification Board – a national certification body with 112 approved education programs – to ensure quality of services for parents in AZ. Section 17-3 Part D requires a bachelor’s degree from a program accredited by the Association for Behavior Analysis International. DOES NOT EXIST! Against Applied Bahavioral Analysis has helped my son with autism to make significant advances. This is recognized by his teacher and occupatonal therapists as well, in addition to friends and family. The therapists that provide his ABA are highly qualified and trained, however do not have the specific credentialling that would be required were this bill to pass. Against Criminalizing behavioral therapy for anyone who did not go to one of the rare ABAI schools will end effective autism therapy in every school in Las Vegas, private or public. Against Tutors/therapists delivering ABA services should NOT be required to have a college degree as they are NOT consultants. Tutors/Therapists are an intricate member of an ABA team but NOT a consultant or person in charge of the direction of treatment. The idea that the tutor/therapist should be required to have a degree is arbitrary and a blatant misunderstanding of ABA and how this important treatment works. Jan-14-2011
Against Who introduced this bill? Who lobbied you? I hope you understand that if this passes it will be the end of competitively priced, effective support systems for kids with autism. Interrupting their therapy is flat out unethical and whomever thought this was a good idea needs to be fired. Parents will be forced to deal with an oligopoly. Only a small few will be able to offer help and prices will sore if the only people who can provide these services have to graduate from one of the rare ABAI programs. Jan-14-2011

Against I wanted to use my comment to repeat what Dr. Ayvazo (PhD, BCBA-D), UNLV, had to say on this subject. All legislators need to pay attention to this: “Board Certified Behavior Analysts are those who had earned the credentials to practice ABA. ABAI accreditation is rare and in this case, redundant. This bill would prevent essential services from many kids with special needs in the LV area and as such, is unethical at best, and a destructive educational act at worse.” Jan-14-2011
Against I agree with a lot of what's in this bill but I vote against. It will restrict the supply of ABA providers to those with a Masters degree from one of the rare programs accredited by ABAI. Consider the financial impact. Public and private schools will be forced to cut behavior analysis from their autism programs. No ABA at schools anymore is basically what this would do. That’s unethical. You’re removing a support system that has proven effective because of where someone chose to go to school years ago. Jan-14-2011
Against UNLV is not currently accredited with the Assoc. for Behavior Analysis International. Passing this bill would limit our access to qualified professionals, as well as pull money away from UNLV, and Nevada. If such a bill were to pass, there should also be a grandfather clause for professionals already practicing in the ABA field. Jan-14-2011

Against This will remove successful and effective support systems currently in place for hundreds and hundreds of children with autism. There is no need to add ABAI when BACB is already certifying these people. Making it criminal to practice without license and certification is also bad for CCSD, UNLV Preschool, Cumorah, Meryhill, Faith Lutheran and every other school with professionals using behavior analysis to help these kids. Against Who does the Board of Psychological Examiners think they’re kidding? Is this just hubris, arrogance or something more targeted? No other state in the country has handed this over to BSE so why Nevada? There is a national certification body for behavior analysts and they have been doing fine for decades without this board. Did this board approve all the long-term outcome studies that validated ABA therapy? It was Psychologists that blamed mothers for causing autism before behavior analysts debunked them. Jan-14-2011
Against Sec 17-3 part D is impossible for ANYONE to obtain because the ABAI have not accredited a single bachelors program in the United States. How can you include a requirement for licensure that's impossible to satisfy and then make it criminal to practice without a license? Against Pattrick Ghezzi and UNR are unscrupulous for trying to secure a monopoly in Nevada. They’re obviously concerned with lining their pockets. The only Board Certified Behavior Analysts who will be permitted to practice ABA in Nevada will be those who graduated from 1 of 13 Masters programs accredited by ABAI in the USA. Against Unreasonably restricts qualifying criteria to a handful of ABAI-accredited universities which potentially excludes existing qualified ABA providers harming NV residents who require and are presently receiving those services. Against My name is Peggy Schaefer Whitby and I am an assistant professor at the University of Nevada-Las Vegas. At UNLV we provide the approved coursework for BCBA certification. We are in a unique situation in this state. Licensing regulations are being developed under the Psychology Board. The current proposal is that all behavior analysts would need to GRADUATE from an ABAI accredited program. Against I believe this bill is unconstitutional because it would create an ex post facto law (retroactive law). It is clear that it would have an ex post facto effect if it is not ex post facto per se. Against 1) Major problem with this language....Page 17 Section 37 - line 41 5) Practices psychology or applied behavior analysis unless he or she has been issued a license [,] or certificate, is guilty of a gross misdemeanor. I believe the way the AB65 reads, all those practicing Applied Behavior Analysis will have to be licensed and certified, this will limit its use in state funded programs, education classrooms, early intervention programs, and increase cost.
