As a metabolic typing adviser, Chek Practitioner, Functional Diagnostic Nutritionist, and NSCA Certified Personal Trainer, I will not stop helping my clients with nutrition. I have a right to give recommendations on nutrition. The nutrition I practice makes the ADA look like complete morons and I would be willing to debate any nutritionist on their completely flawed position and I have more science then you can logically debate against. Criminal actions for violating rules within AB289, do not seem to allow for substancial due process for those found in violation for certain acts. These bills usually lump dietitians and nutritionists into one licensing scheme, and require nutritionists to complete a dietitian program in order to practice nutritional therapy. Even if the nutritionist holds a Masters or a PhD in nutrition, the nutritionist is still required to complete registration through the ADA in order to keep practicing. This is the organization that lists among its corporate sponsors soft drink giants Coca-Cola and PepsiCo, cereal manufacturers General Mills and Kellogg’s, candy maker Mars, and Unilever, the multinational corporation that owns many of the world’s consumer products brands in foods and beverages. The ADA’s legislative manipulations are able to go undetected because it takes years for a bill to go through the regulatory phase and be implemented—so few people become aware of the full consequences of the law. Moreover, the ADA hasn’t yet “pulled the trigger” sending out cease-and-desist letters to nutritionists everywhere telling them they can no longer practice—but you can rest assured this will happen, as soon as the organization has its monopoly firmly established. | Against | As a medical student, I would like the public to have options to take supplements. There is a severely myopic culture in American medicine that neglects educating doctors, dieticians, and traditional medical personnel in supplements and medicinal herbs. Most drugs are derived from plant life and purified. The regulation should fall to the FDA to regulate quality and proper handling of manufactured supplementation, such as strength of the supplement and cleanliness of preparation, and preventing fraud (i.e. providing B12 supplementation for human use versus bacterial use). Otherwise many herbal supplementation takes root from cultures or one's heritage. Trampling on familial heritage from lack of exposure and understanding by a poorly educated medical society is an ignorant and intolerant action. This bill cannot be well implemented in today's medical society. I am a Licensed Massage Therapist in NV, a Licensed Massage Therapist in Missouri, hold an Inactive Massage Therapist License in UT, and a Licensed Massage Practitioner in Washington (State). I am on the faculty of the Northwest Academy of Healing Arts in Tacoma and have a very good background in my field and in some other complementary integrative modalities as well. I spent 20 years in the USAF and retired in 1994 as a Lt. Colonel. I have been professionally trained as a Counselor and have a Master's Degree with a double major in Human Relations Psychology and Business Administration from Webster University in St. Louis, MO. In addition to my formal university degree training, I have invested several years and over $100,000 becoming educated as a 'bodyworker' which included training in Acupuncture, Nutrition, Massage Therapy, training as a Chiropractic Paraprofessional from Logan College of Chiropractic in St. Louis, MO, and a specialty of CranioSacral Therapy by the Upledger Institute in Palm Beach, FL. I'm not some uneducated and uninformed person off the street that has no idea what I am talking about! Since I am licensed by the NV State Board of Massage, the bills don't impact me severely; however, I can see hundreds of competent and well qualified individuals being put out of business and losing their livelihoods because of this bill. The loss to the public will be staggering. I can foresee that it will cause a large number of people to give up on Nevada as a place that they want to live & have already heard a few people state that if this law is passed, they will have no choice but to move to a new state and give up on Nevada as a good place to live! We have a shortage of competent medical people in this state already and many of the great ones have given up and moved away because of the high cost of liability insurance for their professions. | Against | This bill reaches far beyond the originators intent "to protect the people" and attempts to regulate the unlicensed who could stand to lose their livelihoods. As well, Nevadans stand to lose their freedom to choose from an array of nutritional information alternatives. Moreover, this bill attempts to legislate speech and override our First Amendment. Proponents promise this is not the case, but the intent and the letter do not agree. The language of the bill is too vague. The proposed Board would be given cart blanche to interpret the inexplicit “letter” at will. As it reads, the unlicensed would be subject to unwarranted penalties. It's clear that dieticians would like to be recognized as the only ones allowed to call themselves nutritionist, an attempt to place themselves above all others. I believe they will find, as dieticians have found in other states where they have been licensed, that the application and licensing fees proposed will be burdensome, and that their licensure will have little impact on the public. Lastly, as SB 412 is concerned with the licensure of those practicing Complementary and Integetrative Medicine, of which dieticians have been included, they could have be licensed under SB 412 and saved themselves the trouble of introducing a separate bill. In North Carolina a Nutiontionist with a doctorate degree and years of practice has been denied a license because she did not have one specific low level class. | For | As with any other licensed healthcare profession, there are minimum requirements that all practitioners must meet in order to become licensed. These requirements are based on objective standards gleaned from mountains of evidence and which are designed to protect the consumer of licensed services. Anyone who wishes to practice as a licensed professional is free to satisfy these requirements and become licensed. Nobody is going to be excluded provided they meet the set requirements. Anyone objecting to this bill is probably a non-dietitian who doesn't want to do the work required to become licensed. As written and amended, as of this date (May 10th), many feel that the passage of the bill would inadvertently and indirectly outlaw businesses that sell or promote vitamin, mineral, and herbal food supplements by prohibiting the business owners and their employees from discussing a customer’s needs regarding those supplements. While I am not an attorney, judge, or even a paralegal assistant, my reading of the bill, as it is posted on the Nevada Electronic Legislative Information System (NELIS), forces me to concur with their interpretation, specifically by the unintended omission of some critical wording within the bill. Consider, if you will, the range of businesses affected by such a measure: Not only would this affect vitamin and nutritional supplements wholesalers and retailers, but it would include many health foods stores and restaurants that provide supplements on their shelves as a convenience to their customers. The same is true of sports equipment retailers and membership-driven athletic clubs and gyms. Furthermore, there are supermarkets and “big box” retailers like Costco, Wal-Mart, and K-Mart who carry such products. The role of nutrition has expanded in the last 3 decades, and continues to expand, as research and clinical studies demonstrate the role of nutrition and medical nutrition therapy in disease prevention and treatment. Health promotion including medical nutrition therapy will play an increasing role in the healthcare arena to improve quality of life for our citizens and to improve cost control efforts. Preventive care is some of the least expensive care we can deliver and in this day of budget crunch, cost effectiveness is key. Successful medical nutrition therapy requires a practitioner with knowledge in physiology, nutrition, cultural practices, communication, and behavior change strategies. The registered dietitian is the food and nutrition expert with training in these areas and is uniquely qualified to provide the public with nutrition education and participate in treating both acute and chronic disease through medical nutrition therapy. The registered dietitian holds a minimum of a Bachelor's Degree in nutrition from an accredited university, has completed at least 1200 hours of supervised practice, has passed a standardized national exam, and participates in continuing professional education. The registered dietitian through training and experience provides citizens and patients with evidence-based information and nutrition therapy. Dietitians work closely with their prescribing physicians to provide quality care for their patients.
