Against My husband and I have jointly prepared this objection to SB254. This bill MUST be voted down. It drastically reduces homeowner rights and further enhances CIC Board, NV Real Estate Division, and CIC Commission dictatorial powers. Not one single alleged "problem" by CIC/NRED management has led to this bill. SB254 only appears to be interested in improving good management. That is FALSE. SB254 is deceptively designed to bully unit owners to keep them quiet, subservient and allowing their money to be skimmed off like the shearing of sheep. The business interests (CAI organizational members) like to claim there is no such thing as "free or open speech" in CICs, and SB254 is clearly intended to force unquestioned compliance by CIC unit owners by allowing outrageous new penalties for unit owners who dare to challenge all kinds of gross negligence and bullying by boards of directors. People who vote in favor this bill are uncaring individuals who lack compassion for unit owner issues. Not one SB254 proposed change to NRS116 will help unit owners achieve justice for their disputes with board members. Please show you care about CIC citizen rights to property and due process and the NV and US Constitutions. Vote NO on SB254! May-05-2011

I know the individuals who wrote this bill, and I can say with high certainty that their desired changes to NRS 116 are entirely intended to strengthen the board's power to bully unit owners to keep them quiet, subservient and behaving like sheep. The business interests (CAI organizational members) love to claim there is no such thing as "free or open speech" in CICs, and SB254 is clearly intended to further intimidate (and even extort) unquestioned compliance by CIC unit owners by allowing outrageous new penalties for unit owners who dare to challenge all kinds of gross negligence and bullying by boards of directors. Members of the Legislature who vote in favor of this bill will be seen by citizens as uncaring individuals lacking compassion for unit owner issues. I challenge any member of the Legislature to show where even one SB254 proposed change to NRS116 will help unit owners achieve justice for their disputes with board members. SB254 must be killed because the controlling business interests at the State and local levels already have far too much uncontrolled power over the lives of CIC residents. For I had a home in escrow and the HOA dues for 6 months were $120.00 I now owe the HOA $1600. The collection fees for the home in 6 months went to this outrageous amount. No other companies can operate this way, the HOAS are robbing the people who they are there to serve. If you pay your dues while a home is in escrow any amounts already paid go to the new buyer, not refunded to the seller. Either way they take advantage of the home owner. Beleive me, these HOA's are not broke!! Stop this robbing of the comsumers now!! So many are unemployed and these HOAS are doing this to them for $120.00!!! Apr-28-2011

For Again we need legislation that helps Associations maintain our neighborhoods and penalize those that dont' care, don't want to follow the rules they agreed to when they bought their homes, and complain when they don't comply. I'm President of Peccole Ranch Community Association. Our Board works very hard trying to be fair and listen to the concerns of our homeowners. But it is the few that dont' want to follow the rules they agreed to when they bought their homes, that want to make it so they really can't be penalized for not complying. They want to make our beautifull neighborhoods into unsightly blighted areas like other parts of Las Vegas where people don't care, and their is nothing that can be done to force them to maintain their properties. We work with people if they work with us. It is the malcontents that don't that so often complain and twist and distort their circumstances to make it appear they are the victims. Actually it is their neighbors who are the victims. This bill will help the majority in Associations maintain our property values and the reasons we moved into an Association. Apr-25-2011

Against HOAs are in a predicament and I understand it; they need fees to survive. However, collection companies and collection attorneys have so abused their fiduciary responsibilities that it's unbelievable. They routinely turn a monthly assessment of $17.50 and a 9-month super-priority lien obligation of $157.50 into an additional $3,000-5,000 in collection fees! The only economy they are helping is THEIRS, at the expense of hard-working people who are struggling as it is. It's shameful and I never thought I'd say it, but our firm will immediately relocate to another state where collection companies and attorneys aren't getting rich at the expense of others and, unfortunately, we will be forced to lay off all our employees and contractors in Las Vegas. It's not our to do so but attorneys and collection companies are now making far more in the average real estate transaction than real estate agents, contractors, insurance agents, home inspectors, appraisers, mortgage professionals, title and escrow companies, and investors. Collection attorneys and companies are the leaches that prey on homeowners and foreclosure carcasses. Apr-19-2011

For Sometimes some people will never give up. They file multiple claims on the same issue causing the HOA to incur expenses to respond and defend. There should be some limit. I do want due process but want to protect the homeowners against claims that have been heard once or twice or three times already. Apr-12-2011
