| Against | My wife and I purchased a home in Summerlin in 1993. We have been involved in two instances of purported defects stemming from reported failures of the builder(s) to allegedly comply with building standards. One has resulted in a decision by the court(s)that the defect must be fixed, but it is still not done. Without the builder(s) being held accountable for the purported defect(s), we, as homeowners, would have to spend thousands of dollars to correct the defect. The second is still pending disposition. Builders should be knowledgeable of current building codes and standards before building, as the average person wanting to purchase a home does not have the technical knowledge to know how and by what standards a home should be built. | Apr-08-2011 |

| For | SB 306 will actually focus the purpose of Chapter 40 on dealing with and repairing construction defects, instead of being used, as it now is, by unscupulous attorneys and their so called experts as a sure fire way to get to huge amounts of insurance coverage carried by responsible and professional builders and contractors providing housing in Nevada. I therefore respectfully request that you see to the passage of SB306 as presented so that our State will at long last have legislation that will protect its residents and their most prized investment-their homes-from being used as a tool and tainted in the process as defective by the unscrupulous attorneys who have relentlessly alleged laundry lists of defects throughout this State since 1995 for the sole purpose of getting their inflated fees and costs simply by making allegations that need not even be proved to assure huge settlements with the insurance carriers. | Apr-07-2011 |

| For | Why is Nevada the only state in America where automatic attorney fees, costs and pre-judgement interest are permitted for this type of legal process. Result is that repair and settlement costs are dramatically inflated my multiples of 3 plus. As a result, construction defect attorneys are incentivized to spend and increase cost so that if only one of the long list of typical allegations is vallid, they are entitled to ALL costs and fees plus interest. Final result is that this fleecing of Nevada's Residential Building Industry is costing NV Jobs. Specifically translated, NV Families. If this statute is not reformed to remove auto attorney fees and costs and interest, and let this process revert back to "American Rule" then there are thousands more Nevada Jobs (Families) about to be severely impacted. Lets be honest, most of them will not find equivalent work or equivalent compensation anytime soon. Result is additional personal bankruptcies, home foreclosures, etc., etc. Inflicting another blow to a state with an already weakened socio-economic structure. PLEASE SUPPORT THIS BILL. We are strongly considering not selling any windows in Nev because of this totally unfair legislative environment which currently exsist in Nev. Our dealers in Nev are in serious financial trouble because of these unscrupulous attorneys who continue to badger construction firms within the state of Nev.
