Against If you require a 2/3 vote of the membership to approve a collection policy it will never get done. You can't even get people to run for the boards and I have never seen even a majority of owners to vote in annual elections. If an HOA can not get 2/3 of the owners to vote for a collection policy there will be no collection policy. If that happens then the owners will be more inclined to not pay their HOA assessments. I feel that if this happens you will see more and more HOA's going bankrupt and into receivership and they will become the State of Nevada's problem and I don't think the State of Nevada wants that to happen. Against I am President of our HOA. We have about 1100 lot owners. The majority of owners have not built and many of them live out of state. We cannot more than a 50% response rate on any issue even if it involves something that directly benefits the owner. This bill would seriously hurt our ability to collect delinquent fees and would have deleterious effect on our ability to maintain our roads which our community property. Apr-30-2011

Against The bill as written will increase Association's costs, will throw up additional procedural barriers that will make it extremely difficult for Association's to collect seriously delinquent accounts, and will make it cost prohibitive for management companies to process delinquent accounts. If the legislature's intent is to force greater increases in assessments for the paying members to the benefit of members who aren't contributing toward the expenses for the upkeep of their common interest communities, then this is the bill to do it. Against This bill will kill HOA's. They will not be able to collect assessment which is what pays for the repair, replacement an enhancement of the commen elements. Property value of all homeowners in an Association will be effective. It will allow for no homeowner to pay, hence and why should the ones that care pay for the ones that just don't care. Against This is as preposterous as AB388. This is ill-conceived and will be financially devastating to HOAs. The legislature has no more business dictating the fees and costs associated with managing an HOA than it does dictating to the legal profession the limit on an hourly charge for its services. The Executive Board is charged with a responsibility in the governing documents to protect the interests of the Association and all the members. The nature of the fees and costs are commensurate with the time and effort necessary to ensure that reticent, malfeasant homeowners who choose to live in squalor are brought into compliance. Against My yearly dues are $165 where other places are over $100 per month. How can people not afford $165 a year? Their monthly electric bill in the summer time is bigger than that. Against If this is changed, the dues to all homeowners will have to be increased to cover the cost and we have no chance of recovering. The HOA still has to pay to re-roof, paint, landscape, etc. We have to keep a percentage of reserve money to cover the cost of the up keep of these properties. If we can't recover some of this money it all falls to the other homeowners. It will be very frightening to ever live in a condo complex or other HOA's. It will be a big benefit to the banks but once again not to the individual homeowner. If we are unable to collection assessments that are due then the homes will not be able to be maintained and looking nice. We love our community because it is an oasis from the areas around us. Against “Boundaries” needs to be more defined. For one, the Association is to follow the regulations stated in the governing documents for aesthetic maintenance of the property. Generalizing the term also includes patios and balconies where some Units do not have a fenced yard. Some governing documents stipulate that nothing shall be above the wall enclosing the yard visible from the street and/or neighbors. Having to submit an architectural form for approval for any exterior alteration, a homeowner with a patio and/or balcony, could object to being denied by their Board of Directors. The term ought to define boundaries to stipulate that only Units having an enclosed backyard may install a clothesline. The Association may then have a reasonable request that it be installed below the line of visibility from outside the perimeter. It is obvious how many would be disgruntled at having to enjoy their view of their community with an eye-sore of inappropriate use of space hanging from every surrounding balcony. Not to mention articles of clothing that may be blown away and may not be picked up by its owner on a regular basis. Let’s face it, many do care but in reality some don’t. Apr-11-2011

Against This bill unconscionably releases delinquent homeowners from liability for their debts, shifting the burdnen onto the remainder of the association, who pay their bills in full and on time. It also ties the hands of the association to foreclose when delinquencies stretch into many months. Keep in mind that many condominium associations have only a small number of homeowners (ours has only 38 units), and tis will result in exorbitant fees assessed to the homeowners if the HOA is unable to properly deal with delinquents. Banks are not reuqired to complete a foreclosure action in 120 days, so why should an association be held to a stricter standard? This bill appears to be written to benefit banks, not middle class homeowners. Apr-11-2011
Against The fees that are charged are pass through fees that the association incurs for the process of collections. This would be the same as for a private home owner. The association is required by the legislature to maintain a fully funded reserve account. These unexpected costs cannot come from reserves and the regular budget does not have provisions for these unforseen expenses. The rules should not be different just because this is an HOA. The residents expect to be treated fairly and if someone does not pay their dues or special assessments, everyone in the community suffers. Apr-11-2011

Against Collection costs allow the association to get professional help to bring in contractually agreed upon assessments. The banks and deliquent owners do not want to pay assessments. IT IS NOT Right for already strapped HOA members that do pay their bills, to have the added burden to pay for vacant, abandoned or bank owner property? Against I reside in a homeowners association and am a board member in my HOA, Silverado Ranch III. I enjoy living in my HOA and have served on our board now for 4 years. Our Board works very hard to maintain all common areas; landscaping, irrigation lines, water meters and with all the recent foreclosures collection of all our assessment monies necessary to do just that has been very difficult. Now our legislators present bills such as AB394 that are unrealistic and do not allow associations to go about the important fiduciary responsibility of collecting assessments in a timely manner. The collection procedures, as they are a legal procedure, is one that cannot be done by our association and our Board seeks out professionals with proper licensing and expertise to perform these collection functions. These professionals will not contract the necessary functions of collections including liens and notices of default/election to sell for the amounts as detailed in AB394. Therefore, you will cause our association to either not collect rightful assessments from the select few that are neglectful in their duties to pay their fair share to maintain and repair common areas or cause the association to collect the small cost as detailed in this bill while having to take 'good' owners' paid assessment operating funds to pay those collection costs for those that do not have the care and concern of their association at all. I agree that a cap should be set for collection costs associations may charge back to their owners, but make it reasonable and workable in the real world of todays collection attorneys and collection agencies; maybe take Senator Copening's suggested cap of $1,800!!! That is fair more business reasonable and allow associations to collect their necessary assessments to keep up all their common areas!! Remember, if you do away with the HOA, the Counties and State will have to take over the maintenance of all streets, sidewalks, walls, landscaping, water and ele Apr-11-2011
