Yet when these programs fail, the free market is blamed, and more regulation is deemed necessary. I am an officer of the Greyhaven TH Association. We have 36 units and do not need to have our fees raised in order to give more power to gov't agencies. Such regulations are causing HOA's to go bk in Reno due to exorbitant fees. This will result in lower property taxes which in turn will cause the cities and counties to have even less funds for maintenance & services. Associations will still have to cover the costs that they may not pass onto a homeower since this bill is capping the amounts that Associations may recover from homeowner. This bill is not beneficial to the board, association or homeowners who follow the governing documents. This is only beneficial to the few homeowners who refuse to follow the governing documents they agreed to when they purchased their property. It is even worse now that many homeowners don't care about their properties since they have seen their equity diminished. From my experience as both a board member and common-interest community homeowner, I am sure the requests for these revisions are the result of a few disgruntled homeowners making their voices heard and not the wishes of the majority. As just one example, a cap on the fines that may be imposed effectively allows any homeowner to choose to pay one up-front fine to ignore any rule they diagree with. "I can put in drought tolerant landscaping for $5000 or I can pay $2500 and not have to water or maintain my lot at all..." Easy (but bad) choice. | Against | I am a Board member of my homeowners association Silverado Ranch III and feel this bill would be destructive for associations in Nevada. We have 433 single family homes with almost 40% of our owners delinquent in their assessments. If we are not allowed to act in our fiduciary responsibility to collect assessments in a timely manner, we may be forced to cut services which would destroy our community and bring our home values down even further than the 50% we've already experienced. We depend on professionals to draft necessary legal documents to enforce our right to collect our assessments, and they do not work for free! I would like to express my opposition to AB448, which will be heard in Assembly Subcommittee on the Judiciary. I enjoy my HOA and all it offers and I want to ensure that my HOA is not hurt financially or otherwise. I believe AB448 will impede my HOA from enforcing the governing documents and collecting unpaid assessments. This will not allow me as a board member and DCAL to fulfill my fiduciary responsibility for the two associations that I serve. AB448 will hurt the residents who abide by the rules to which they committed prior to purchasing their homes in an HOA. Ultimately, AB448 will destroy property values. I enjoy my HOA and I assure you that the negative media reports are unusual exceptions and not typical. I ask you to please OPPOSE AB448. HOAs provide far more benefits to property values and the community than drawbacks. Additionally, homeowners have a choice as to whether they live in an HOA or not. About 95% of the homeowners are responsibly caring for their properties; about 5% are not. HOA Boards need the authority to enforce CC&R's in a fair and equitable way that does not result in additional costs to those responsible residents in good standing. Blight and unsightly properties damage the values of good properties in the neighborhood through no fault of the responsible owners. Taking away authorities of Boards, establishing unnecessary procedures which add to the costs of Associations, and reducing the financial responsibilities of the irresponsible owners is going in the wrong direction, from both a realistic and moral perspective. Responsible Boards are sympathetic to the owners facing financial difficulties in this economy and allow for extensions and other temporary relief where such owners are willing to talk to their Board members. I personally am trying to establish allowable policies within the statutes and the CC&R's to accommodate those with existing financial and/or health hardships. Limitations on collection charges can only hurt the association (and the owners paying the bills) because fees, such as to file liens, are not determined by the amount due, but by the time and effort involved. Why should the association have a limit on collection costs? It costs what it costs. The association is trying to protect the other PAYING owners. The association collects money to maintain the premises for which the owners bought the property. Many parts of this bill require the association to provide copies at no charge. Who do you think is paying for this? That certainly has an impact on the fees collected from all members to satisfy the whims of a few individuals who can demand copies just for the sake of overwhelming the management company.
