Against	Goverment regulation of the economy is not a free market practice but benefits only special interests, creating business monopolies. Yet when these programs fail, the free market is blamed, and more regulation is deemed necessary. I am an officer of the Greyhaven TH Association. We have 36 units and do not need to have our fees raised in order to give more power to gov't agencies. Such regulations are causing HOA's to go bk in Reno due to exorbitant fees. Against	This bill worries me since the HOA's won't have the money to maintain the common areas and enforce the basic rules due to lack of funds and the neighborhoods could go blight and cause value to further decline which is a decline in property values. This will result in lower property taxes which in turn will cause the cities and counties to have even less funds for maintenance & services. Associations will still have to cover the costs that they may not pass onto a homeower since this bill is capping the amounts that Associations may recover from homeowner. Ultimately causing large increases in Association fees and/or failure to be able to enforce the governing documents and maintain the common areas due to lack of funds. Against	We're looking at more knee jerk HOA legislation because some organizations have violated their own governing documents. Why are you going to make it more difficult for those organizations that are playing by the rules? There are better ways to handle this kind of issue than adding even more layers to already confusing documents. I've been on our board for 2 years and it seems no matter what we do, we're bogged down by additional, revised or new legistlation. Instead of satisfying a few people who have had a serious problem, put money and headcount into the Ombudsmans office or other state organizations that could really hold renegade HOA's accountable. For	Please continue your work to get reason back into the law concerning CIC (HOAs) and the property managers and attorneys who continue to milk this system. There is an active lobby out there working to convince you that these changes are not positive for homeowners in HOA (that's how I know about this). I read each change described online - and I can tell you... these efforts are IN FAVOR of the homeowners, and don't go far enough to bring reason to the HOA system in Nevada. But, they are surely a step in the right direction. CIC law has far too long been slanted to attorneys that "specialize" in HOA law. If you are uncertain of this, just try to locate a good attorney that will represent and defend a homeowner. In contrast, they all love to represent HOAs. An HOA should not be allowed to foreclose on a property - they can wait to get paid on a lien like anyone else. This ability is used like a hammer, and HOAs take on the form of a local government. Please, don't be turned from your efforts based on the organized lobby that will undoubtably assault you. Against	This is a particularly bad bill with a number of very negative impacts on existing fair and reasonable provisions impacting finances and the governance of community associations. It has an ill conceived & unworkable mandate requiring majority voting on collection policies...typically a routine matter vetted through an attorney. Similarly, the restrictions on fine and collections are too restrictive and counterproductive. The limit on collection fees equates to current homeowners subsidizing the cost of collections for delinquent owners, who are ignoring their financial responsibilities.	May-03-2011

Against	I have lived in a common-interest community for almost 20 years and served on the board for approximately 8 years. This bill is not beneficial to the board, association or homeowners who follow the governing documents. This is only beneficial to the few homeowners who refuse to follow the governing documents they agreed to when they purchased their property. It is even worse now that many homeowners don't care about their properties since they have seen their equity diminished. From my experience as both a board member and common-interest community homeowner, I am sure the requests for these revisions are the result of a few disgruntled homeowners making their voices heard and not the wishes of the majority. It is always easier to get the bad stories heard becuase that is what makes lawmakers take notice. It takes reasonable people to know that not everything needs to be changed and when what is in place is the best solution for the majority of the people.	May-03-2011

Against	I am a happy owner in an HOA and am president of a large master association. This bill will effectively kill common interest communities and place the burden of maintenance of vast areas on the cities and counties of Nevada. There is not one provision of this bill that should be saved. As just one example, a cap on the fines that may be imposed effectively allows any homeowner to choose to pay one up-front fine to ignore any rule they diagree with. "I can put in drought tolerant landscaping for $5000 or I can pay $2500 and not have to water or maintain my lot at all..." Easy (but bad) choice. I have lived in HOAs for 30 years, and I would seriously consider moving out of Nevada if I couldn't enjoy the same protections here. Against	I am a Board member of my homeowners association Silverado Ranch III and feel this bill would be destructive for associations in Nevada. We have 433 single family homes with almost 40% of our owners delinquent in their assessments. If we are not allowed to act in our fiduciary responsibility to collect assessments in a timely manner, we may be forced to cut services which would destroy our community and bring our home values down even further than the 50% we've already experienced. We depend on professionals to draft necessary legal documents to enforce our right to collect our assessments, and they do not work for free! I am a homeowner and choose to be in an HOA and pay my bills and my assessments! I do not wish to have to pick up the 'tab' for those owners that don't, so please VOTE AGAINST this bill!!! Against	I am a board president for a sub-association. Please do not restrict our ability to collect delinquent assessments. Putting caps or limits on the language of what is a "cost" and "fee" will mean our responsible homeowners who do pay on time will be responsible for covering the collection costs of those who don't. I recognize that collection company fees are extremely high, but that's to DISCOURAGE homeowners from letting their accounts get to this point. I have experience in all areas. Lets put the burden on the realtors who don't provide governing documents before purchase, management companies that don't keep their board up to date on a legal issues and train board members and board members who do not have the interests of the hoa in mind and have their own agendas. The hoas that I manage are happy thriving communities with educated board members. There are plenty of laws on the books to keep all community managers busy. Let's prosecute the non-law abiding lawyers, management companies, community managers and board members. There is no teeth in the Ombudsman's Office, let's get rid of this process and do it through the real estate division. They have no problems policing the violations by Realtors. The Ombudsman gets no where. This bill will only restrict hoa's in all areas in a negative way and impact communities negatively. I would like to express my opposition to AB448, which will be heard in Assembly Subcommittee on the Judiciary. I enjoy my HOA and all it offers and I want to ensure that my HOA is not hurt financially or otherwise. I believe AB448 will impede my HOA from enforcing the governing documents and collecting unpaid assessments. This will not allow me as a board member and DCAL to fulfill my fiduciary responsibility for the two associations that I serve. AB448 will hurt the residents who abide by the rules to which they committed prior to purchasing their homes in an HOA. Ultimately, AB448 will destroy property values. I enjoy my HOA and I assure you that the negative media reports are unusual exceptions and not typical. I ask you to please OPPOSE AB448. HOAs provide far more benefits to property values and the community than drawbacks. Additionally, homeowners have a choice as to whether they live in an HOA or not. The community is larger than 4 counties and several cities in Nevada and this bill would create chaos for our community. Against	I am a board member president for a sub-association. This bill would hamstring our ability to govern an association and the rule-followers would pay for the rule-breakers. With the proposed fine cap, for $2500, I can just buy my way out of a rule and blight the rest of the neighborhood. In my sub-association, on-street resident parking is prohibited. If an owner just paid the $2500 maximum fine and parked on the street anyway, that would also increase the damage done to the roads, increasing the costs to all other residents as the frequency of the street seal maintenance would need to be increased. This is a bill to protect rule violators who WILLINGLY bought into an association where the rules were made available to them before purchase. If you have ever dealt with volunteers, many times it is very difficult to recruit them and then for them to show up consistently. Against	I have been recently elected to our HOA Board for the first time. I volunteer my time because being part of an HOA community carries certain responsibilities for the upkeep of the community. About 95% of the homeowners are responsibly caring for their properties; about 5% are not. HOA Boards need the authority to enforce CC&R's in a fair and equitable way that does not result in additional costs to those responsible residents in good standing. Blight and unsightly properties damage the values of good properties in the neighborhood through no fault of the responsible owners. Taking away authorities of Boards, establishing unnecessary procedures which add to the costs of Associations, and reducing the financial responsibilities of the irresponsible owners is going in the wrong direction, from both a realistic and moral perspective. Responsible Boards are sympathetic to the owners facing financial difficulties in this economy and allow for extensions and other temporary relief where such owners are willing to talk to their Board members. It is nice to include them and tenants, so they know what may affect them, but they have no RIGHTS. Requiring hours of classes will simply discourage owners from volunteering to serve their community. Education is laudable, and a good volunteer will seek information. But who is to police this, and what does an association do with that member if they do not meet this requirement? Prohibiting service by spouses further reduces the pool of volunteers. Only about 10% of any organization is ever active in the organization as it is. Ask any club. Lifetime limit on fines is ridiculous. Some people move into an HOA and then do nothing but complain about the rules. Once they pay $2500, they will have no incentive to be a good community member. Limitations on collection charges can only hurt the association (and the owners paying the bills) because fees, such as to file liens, are not determined by the amount due, but by the time and effort involved. Why should the association have a limit on collection costs? It costs what it costs. The association is trying to protect the other PAYING owners. The association collects money to maintain the premises for which the owners bought the property. Many parts of this bill require the association to provide copies at no charge. Who do you think is paying for this? That certainly has an impact on the fees collected from all members to satisfy the whims of a few individuals who can demand copies just for the sake of overwhelming the management company. For	I have lived in an HOA for 12 years and have had to live next door to a health & fire hazard for those 12 years. The HOA has done nothing. I have fought them and their Management Company (Desert HOA Management) Scott Hedlind for 8 years. I went to the Board meetings to ask what is being done and also wrote letters for the past 8 years.
