Against For the record, it is my understanding that passage of this bill would place a heavy burden of new rules on nonprofit organizations and give unprecedented unconstitutional powers to the Secretary of State. I oppose these draconian new Rules for non-profit organizations that would be enforced by the Secretary of State and State Attorney General. May-12-2013
Against I find the SOS office to be unhelpful in answering any question when I have had to deal with them with questions in the past. Ross Miller uses his office to be a collector of taxes from the public even when certain questions arise and should be considered as outside the scope of what the law says. His office is constituent unfriendly as they rule as judge and bill collector without even examining the facts. I would not want the SOS office to be over this matter! May-12-2013

AB60 is a bill containing unprecedented state reporting requirements and potential fines for ALL non-profits, especially for tax-deductible non-profits which are 501 c 3’s like most charitable, fraternal, and issue educational organizations. It gives the Secretary of State the authority without cause “to investigate the transactions, solicitations and relationships” of a non-profit organization and their directors. The bill has no requirement of probable cause of wrong doing to trigger the investigation. For any reason whatsoever, the SOS can decide to investigate any non-profit organization and their directors and officers. The SOS may “subpoena witnesses and require the production of any books, papers, correspondence, memoranda, agreements or other documents.” The SOS can do all of this which violates the Fourth Amendment of the U.S. Constitution and Article 1 Section 18 of the Nevada Constitution, which are nearly identical. Against To require more reporting and oversight is onerous and counter-productive. We operate a dog rescue group that is already subject to existing laws in Nevada and all covering a registered 501c3 organization. We are typical in that we do this with no overhead, no paid volunteers and on a shoestring. Please don't lose sight of the fact that making it more difficult to operate may mean it is impossible to operate, and that would be a shame. Apr-04-2013

Against AB 60 would establish another bundle of red tape for non profit charities to wrestle with. NRS already provide limitations and punishment for fraudulent solicitations. We do not require more redundant regulations, that would stifle legitimate non profits. Many of them are already operating on shoestring budgets with volunteer labor. AB 60 would create administrative and financial difficulties that many established non profits would find impossible to overcome. The Nevada Secratary of State does not need the overreaching autocratic powers that this Bill would authorize. Against When a person exercises their Constitutional right of association and joins an organization, it does not result in the loss of all of their other Constitutional rights because they are part of an organization. Non-profit organizations provide a vast variety of worthwhile services to our society…spiritual, charitable, educational, services to veterans, families, children, the disabled, issue advocacy, etc. etc. etc. They provide citizens the opportunity to band together for a greater cause. This bill gives the Secretary of State the unprecedented authority to arbitrarily “ascertain whether…the purposes of the [non-profit] corporation are being carried out in accordance with their articles of incorporation or any other instrument setting forth the purposes of the corporation.” The bill prohibits non-profits from soliciting contributions unless they have registered with the SOS. Against Many non-profits are focusing on getting the "income" they generate into the hands of the people/causes that need it. This bill does not appear to do anything other than create another layer of regulation through which a non-profit must wade, including financial penalties for non-submission of certain information to the state. I would rather those dollars end up doing good in the community. As a person who supports many charities, it is my JOB to ensure that MY money, which I freely give and which is an extension of my freedom of expression, ends up where I want it to, not the government's. If I feel that they are not spending my dollars the way I want, then I stop donating. Simple as that. I do not need the Secretary of State wasting a moment's time doing this for me. Against Both the "original BDR summary" and the "current bill title" are highly deceptive. They hide the act that this bill gives the SoS new arbitrary power to investigate, charge and punish non-profits without probable cause or due process. It seems to be based on a legal theory that allows different treatment of voluntary associations (such as corporations and other fictitious persons) and the natural persons who are members of a voluntary association. The problem is that while a corporation owns tangible and intangible property and is actively engaged in business to generate income, which are the only targets of any legal action against it, a non-profit association depends on voluntary donations from the public and otherwise has very little or no assets. Therefore any civil or criminal action against a non-profit organization is in fact an action against the natural persons acting on behalf of and making contributions to the non-profit organization, and when such action is capricious and arbitrary, as this bill allows, and when it in effect deprives the natural person members of their basic constitutional rights of probable cause and due process in a court of law, then it is in fact a direct violation of the US and NV Constitutions and several provisions in the NRS. Against I realize the idea behind this bill is to make non-profits more accountable. I know there has been fraud connected with them in a few cases. However, the reporting and associated costs with this bill will be in excess of what the average non-profit will be able to manage.The average non profit does not have the trained staff to engage in lengthy reporting processes. Against Non-profits use their funds for specific purposes, especially charitable activities. The amount of funds they operate with is marginal. Giving the Secretary of State permission to carry out investigations and demands without probable cause of illegal activity will create a bureaucratic nightmare for the non profits and their funds will be used to respond to charges rather than for their intended purposes. This will drive non profits out of business and the state will then have to provide the services. This bill is probably in violation of the Nevada Constitution and needs to be defeated. It may also be used to limit free speech. This is a NO GO bill. Please vote against it. Feb-18-2013

It is my belief that it is the fundamental constitutional right of our citizens to keep government in check, not for government to keep individuals or companies under unfair scrutiny at the expense of constitutional freedom and under the guise of government trying to help people by filling its own coffers. NO investigations or excessive reporting should be required UNLESS there is a demonstrated problem or complaint about a nonprofit corporation.
