Against Unconstitutional! Judical branch cannot govern Executive branch. Allowing a Judge to appoint is same as Judge hiring anyone off the street. Bailiffs and Deputy Marshals are peace officers in the State of Nevada and should be governed and hired as such. Mar-05-2013

For This bill will ease the difficulties in hiring court bailiffs in smaller counties where Category 1 officers are in limited supply. The counties that state that there will be a fiscal impact are incorrect and have not properly read the Bill, as it states AUTHORIZES and in no way demands the hiring of said bailiffs, therefore the only impact would be safer courtrooms, the courts could even hire volunteers with this new legislation, even saving these counties money. Against Allowing the justice of the peace in rural jurisdictions to appoint a bailiff or deputy marshal without requiring them to become POST certified in the State of Nevada causes a number of concerns. It would bypass the NAC 289 requirements for a background investigation, polygraph, and psychological evaluation which have been put into place to ensure those that have the authority to make arrests and enforce laws are of the highest ethical and mental standards. Additionally, if an emergency incident were to occur at a rural courthouse, the responding agencies such as the local Sheriff’s Office or the Nevada State Highway Patrol, would expect the bailiff/deputy marshal to be trained in the same procedures that they are, and know how to deal with active shooters, felony vehicle stops, or even the basic handling of a crime scene. This bill would fly in the face of every public safety officer in the state and puts the judiciary, the public and even criminals at risk. Feb-07-2013
