| Against | I do not support this bill. Most of our families are hanging by a thread financially. Yes, it's clear that we need to increase funding for our schools. But we should do it from economic development, create new businesses and get more people back to work. This would increase revenues from business taxes and payroll taxes, as opposed to putting this burden on the few people left who have an income while sparing big businesses that have become hugely profitable by robbing the states natural resources. | Against | While I applaud the apparent intent of A.B. 49; increasing taxes to provide Constitutional Rights is not the way to proceed. The simplest way for Nevada to diminish this portion of the national urban crisis is to change the wording of NRS 193.150 from “Every person convicted of a misdemeanor shall be punished by imprisonment in the county jail for not more than six months” to “...not more than six months, less one day.” Doing this would eliminate the need for public defenders in misdemeanor cases. This would not only help avoid the costs associated with hiring so many attorneys, it would also help foster respect for the system as defendants would then be allowed to speak their peace (or piece if you prefer) before a judge instead of having a government paid attorney make all decisions and force them upon defendants. This would free attorneys to spend more time with those charged with felonies who really do need the assistance of a good attorney. I suggest that judges and attorneys read Healing Trauma by Peter Levine, Ph.D. Understanding the effects of trauma, even when it doesn’t reach the level of Post Traumatic Stress Disorder needs to be the next step in developing good jurisprudence. While it has been 19 years since I last had to deal with a public defender – (I managed to get the S.O.B. fired – or at least forced to resign – I’m not sure which) my experience with public defenders (In the State of California and County of Los Angeles) left me with complete, total and absolute disgust. | Against | The Deputy Public Defenders are paid by the counties in which they serve, just as the Deputy District Attorneys are. To add a tax to fund the Public Defenders, with no possible way to enforce that the funds are used to solely defend the indigent, is unfair to the people of this state. There simply cannot be a proper or effective check and balance to oversee the use of the funds. Also, this bill would force a tax on all citizens of this state to further fund the defense of the accused, while providing no additional funds to the county prosecutors to screen the cases to determine if they are worthy of prosecution, as well as providing no funding to prosecute cases they determine are worthy of prosecution. This Bill would force an inequality of justice, something that we must stand against. At the very least, no party in the justice system should be allowed any advantage, as justice is not only supposed to be blind, but also equal, not only for the accused, but for civil society and the accuser. | Feb-23-2013 |

It does not cost more to write a larger check. This bill also authorizes counties to levy an additional 1/8th cent tax. The total is an additional 1/4th cent to the tax paying public. Is there no legal limit on the maximum amount to which the sales tax can be raised? Is this the rate is set, bit by bit, salami slice by salami slice?
