For The mining industry - primarily the two Out-of-State "golden geese" - Barrick and Newmont - have been consuming NV's Nonrenewable resources, pooping (destroying NV's solitude, and failing to report environmental releases, and terminating employees despite having higher Pre-Tax income), and yes, laying golden eggs. However, only 1% of the proceeds from the golden eggs produced from these "golden geese" stay at the NV farm, while the rest of the proceeds are used to fund $Multi-Billion Mining Mistakes. http://tinyurl.com/BADGOOSE Rural counties for decades have depended on LV and Reno, especially in Elko, where the largest employer is not the mining industry, but the school district. http://tinyurl.com/SJR154ECSD While the mines argue that they pay more tax per employee, this statement does nothing but identify that the mines do less for NV's workforce than they do for NV's General Fund. Said another way, in light of the $Billions taken out of NV to fund these $Billion Blunders in other countries, it can also be said that the mining industry also blows through more money on bad decisions, with the least amount of employees and while contributing the least amount to NV, than any other industry in the State, and despite extremely favorable tax treatment. Furthermore, because the mining industry actually employs ~3,000 less employees now than in 2007, these golden geese are even worse with their money when their gross proceeds grow. Passing SJR15* is the first step in helping these golden geese from throwing their money, and NV's resources, away on big mistakes made by Out-of-State managers. http://tinyurl.com/PJDbike The only way these “golden geese” would be killed by passing SJR15 is for them to kill themselves. NV seems to simply be asking to keep some of the proceeds from the “golden egg” sales in NV – which would also help these incompetent “golden geese” from blowing $Billions on unproductive geese in other countries and wasting shareholders money. Against The original law is written correctly. If it is necessary to raise the rate 1% - 5% that would be understandable. It should never be that business is taxed on gross revenue, i.e. it is much more tolerable to tax net proceeds. All business taxes should be based on net and never gross proceeds. This is well over 40% of the companies annual production worldwide. Newmont Mining owns 18 mines and 14 processing plants in Nevada. The mining companies are not going anywhere else. The gold is here. Tax them fairly. It is sad to see how much money this state makes and how little they give towards education. You should all be ashamed of yourselves. Mining in Nevada provides very few jobs, and engages in a number of under-handed practices so that they do not pay their fair share of taxes. Foreign and out-of-state mine owners and investors export Nevada's resources and exploit our landscape, and leave Nevadans with a mess to clean up. Most other countries have rates that fluctuate between 5 and 50%. For When mining’s tax structure protections were written into the state Constitution back in 1864, Nevada was a very different place. The import of mining’s contributions to the State and its place in the landscape of Nevada’s economic well-being was huge. But the recognition that mining no longer needs such protections has been well-known to the State and its citizens for at least 25 years and various efforts to change this have been underway since 1989. Today, Nevada faces unprecedented budget shortfalls and simultaneous, desperate needs for revenue to address big and costly problems within our State: deteriorating roads and highways, an education system at the bottom in the nation, threats to public safety due to reduced workforces, and a myriad of efforts and programs to put our residents and the nation’s hardest hit back to work. The needs of the State of have become dire and the reasons to protect mining have become moot. We need to create a level playing field that doesn’t allow exceptions for those who don’t warrant it or need it. Many of mining’s owners who our Constitution currently protects are, in many cases, foreign-based companies, who are getting rich off of Nevada’s limited precious resources and taking their money out of Nevada. We can’t ever afford to continue giving mining owners protections that: (1) are no longer warranted; (2) discriminate against other industries not granted similar protections; and (3) allow that same industry to take their proceeds out of Nevada, but most especially not at a time like now, when the State is facing such significant revenue challenges. For While I am not against the mining industry, the constitutional exemption they enjoy puts the State of Nevada and all other of its businesses at a disadvantage. A modest amount of additional revenue is needed to stop the “brain drain” out of the public schools and universities. However this must not be raised by any means that could be construed as a tax on income – whether on gross receipts, payrolls, net profits or dividends. I know from my work as an accountant and tax preparer in Illinois and California what an administrative burden income taxation is to both individuals and businesses. I also lived in Washington State that imposes a “Business & Occupation” tax on gross receipts without regard to whether the enterprise is actually profitable. The “B&O tax” is an especially onerous burden on small business. Yet this is exactly the sort of tax that would be imposed by the so-called “Teachers’ Initiative.” Nevada’s cachet of remaining among only seven states which levy neither personal nor corporate income taxes is essential for future economic vitality. It makes up for our state’s geographic isolation, paucity of water, and lack of arable land. Mining must pay its fair share if Nevada is to avoid regressive taxation that would alienate investors and entrepreneurs, and place an intolerable burden on small businesses and ordinary working folks. Therefore I urge a ‘YES’ vote on Senate Joint Resolution 15. Mar-23-2013

For Out-of-State Corporations are making $Billions in revenue from NV’s resources. They send the profits out of NV. As the report below shows, these Out-of-Sate Corporations contribute very little to the NV’s General Fund– a measly 1%. Ask Chris Nielsen The industry’s reps (including Pete) will argue that the mines donate money. Unfortunately, they then get to select who, and how much, taking the distribution out of the control of NV’s govt. The donations of not amount to what NV and the County would receive if they were taxed on a 6.75 Gross Proceeds amount ($780 Million). The mines are not hiring like the NMA would like you to believe. Jerrit Canyon terminated 400, and in violation of the WARN Act. Recently, NEM’s poor business decisions in CO contributed to a “series of layoffs” in NV (9/12)- spun to be caused by increasing costs – costs which could have been mitigated had NEM’s Supply Chain Managers in CO not failed to negotiate better contracts. Consequently, the poor business decisions made in other parts of the world have a negative impact on the employees working in NV – NV is held hostage to out-of-state incompetency. SJR15 needs to pass so NV residents in Elko can have the choice to vote this protection out. Against Any knee-jerk decision in favor of SJR15 based on melodramatic, misleading propaganda by PLAN or other anti-mining groups will hurt the mining industry in a manner that will ultimately hurt the state, particularly when gold prices drop but costs continue to climb. Please educate yourself on ALL the dizzying business risks that are exclusive to mining. You'll find that it's far more of a gamble than blowing your cash at a casino (look at Barrick's Q4 2012 report, as well as Rodeo Creek's recent bankruptcy filing). Also, learn about ALL the other different forms of revenue - including other taxes and fees - that mining generates for the state and counties when it is doing well. Furthermore, look at the charitable support to communities that mining companies and employees are able to provide (BETTER THAN STATE OR COUNTY ASSISTANCE) when business is strong (ex: Newmont's award-winning NMC Legacy Fund). For The 2011 Barrick Mining annual report is out. If you read it, there are some very interesting facts that emerge. This is a link to the Barrick Annual Report for 2011. http://www.barrick.com/theme/barrick/fil... Barrick Mining either owns outright, or is a partner in a joint venture in 7 gold mines in Nevada. To determine my estimate a profits for 2011, I assumed the price of gold at $1500 per ounce, or less. The current price for gold is in excess of $1750 per ounce. The first four mines listed are totally owned by Barrick Mining. In 2011, according to their own figures, Barrick Mining produced almost 97 TONS of gold from their Nevada Mines. That is same weight as 16 full size, original HUMMERS. Barrick Mining has reported record profits and dividends in both 2010 and 2011. The Cortez Hills Mine produced 1.42 Million (44.375 tons) ounces of Gold at a cost of $245 per ounce. If you assume a conservative profit of $1000 per ounce, you get a profit for the Cortez Hill mine of $1,420,000,000. Barrick paid a total of $47,300,000 in local and state taxes last year. Bald Mountain Mine produced 93,000 ounces (2.9 tons) at a cost of $558 per ounce. Assuming a profit of $900 per ounce for the Bald Mountain Mine, you get a profit of $83,700,000. The Gold Strike mine produced 1.09 MILLION ounces (34.0625 Tons) at a cost of $511 per ounce. Again assuming a profit of $900 per ounce for the Gold Strike mine, you get a profit of $981,000,000. Ruby Hill mine produced 127,000 ounces (3.96875 tons) at a cost of $334 per ounce. Assuming a profit of $1000 per ounce for Ruby Hill, you get a profit of $127,000,000. Barrick Mining is involved in three joint ventures in Nevada. Barrick owns 33% of the Marigold mine. Barrick's share of production was 51,000 ounces (1.59675 Tons) at a cost of $761 per ounce. For the Marigold mine, assume a profit of $700 per ounce. The total profit would be $35,700,000. Barrick owns 50% of the Round Mountain mine. Barrick's share was 178,000 ounces ( Feb-04-2013
