For I was surprised that this "alleged" language had to be added but am glad it is. As for images - for some time we've included images of violations not only so that offsite homeowners have documentation for their own tenant action, but because it helps ensure there is no confusion on which address, vehicle or resident caused the violation. Images are not always available so I don't think they should be mandatory but should be used whenever possible. Mar-12-2013

For Please, support this bill. Through our current management company, our association does this already, but this bill would provide a more even standard. Prior management companies played a "guess what's wrong" game by supplying a poor description without location on the lot. Remedy to cure was sometimes missing or confusing. That's why they no longer are our community management companies. Their lack of effort means they can underbid excellent companies doing more work to do things in a complete and thoughtful manner. For As a member of my Association's Board of Directors, we already use photographs for notices of violations (not courtesy notices as we have intelligent homeowners that understand that if the courtesy notice reminds them that there are weeds visible from the street, they know what to do) However, when it comes to the violation stage, yes some people need pictures. The management contract clearly states the cost for pictures for violations and it was a discussion when we signed the contract. I am concerned that as a volunteer Board member, that the standards by Mr. Friedrich not be implemented. The Board has no reason to tresspass on a homeowner's property to provide the level of specificity of the type of weed, nor do I want the liability to specify you should use product XYZ, to cure the problem. As an additional comment, I was shocked to hear the manager/board/association bashing that occured by those who are presumed to be expert homeowners. Please understand that they do not speak for me,and I would strongly suggest that some of them would benefit from the classes for homeowners that are provided for by CAI, management companies and organizations that help to educate homeowners. THANK YOU FOR THE REASONABLENESS OF THE PROPOSED LEGISLATION - as written and for the consideration of implementation within a reasonable amount of time, so that the options to choose from the current management companies is not reduced to a handful of MEGA management companies/groups. For I am in general support of this bill with some concerns. One please don't accept the amendment request from Jonathan Friedrich for removing reasonable. A clear picture can be obtained in some cases only if HOA's use of drones or trespassing which I don't think anyone wants the HOA to be forced to do. Reasonable detail is weeds in right side of house. Detail could be agued knowing the species of weed or cause of stain. As well management and the board can't tell someone specifically how to fix it as this is a liability issue. They should tell them that an item needs to be cleaned or within the community design guidelines for landscaping needs. Specifics to how to fix should be left to the homeowner as long as it is to community standards which should be within the CC&R's or design guidelines. Finally photos often are more detailed until you print it in black and white printer. This could add an expense to the HOA to have management print color for every letter that goes out. Currently our management will email the higher resolution photo upon request from the homeowner for further explination. Also how big will the photo need to be on the letter? If it is weeds and you zoom in now it can be anyones yard or in any location on one particular yard. a little communication generated from the letter is the best thing, actual communications beyond a letter between the management and the homeowner email or other forms. One it shows the homeowner is interested in fixing the situation instead of the mass ignorance from the greater majority of violators. Mar-08-2013
Against For communities with large amounts of violations, this bill would be very time consuming and generate additional costs, possibly causing higher HOA fees for residents and owners. I own some condominiums in the Reno area and raising HOA fees would result in requiring higher rent. In today's difficult economy, I do not wish to raise the rent on any of my tenants. Mar-08-2013

For I like the fact that our neighborhood holds certain standards for it's residents, and have seen many older neighborhoods, and even some newer ones, fall into disrepair. I do believe at times, there can be too many rules and regulations, but we chose to live in a community with a strict HOA to keep up our property value and aesthetics. I don't think that should be taken away, or regulated, when we chose this neighborhood partially because of it. Mar-07-2013

For Photographic proof is cheap. Photos are extremely important when the entity giving the citation, hearing the charges, deciding the validity of the allegations, and setting the amount of the penalty is the same entity. There is no division power in an HOA. Stop stupid fines, designed to harass, intimidate and pay for operating costs of the HOA. Mar-07-2013

For As both a homeowner and a board member, I support this clarification of violation procedures to include a photograph and a suggested action. It would be nice to add the word "suggested action" so that the board isn't held liable if the "suggested action" doesn't work. For example, the violation is for wall leaching. The board is to suggest what, and how specifically? Treat the wall to remove the stains? If no other detail is required, then that's fine. But I don't want to be put in a place to tell a homeowner to go buy product X, apply in such-a-such manner, etc. Mar-06-2013

This bill treats all Associations as if they were very large, with club houses etc. our budget is very small, and has very little wiggle room. For While enactment of the Bill will require many HOA's to change their procedures concerning Hearing Letters and including pictures of the violation(s) with the letters, I believe that the Bill will provide homeowners with the clarity necessary to understand the violation and what remediation is required to eliminate the violation. For I am in support of this bill to a point. As a member of a mid sized HOA, we don't have the financial resources to implement the photograph portion of this bill right away. Against SB130 as proposed will make my Association send out a violation letter to the unit owners indicating the violation with detail, how to cure it and a picture. I do not want my assessments to increase, with my Association having to include a picture with all violation letters it will drive up the administrative cost which will increase my assessments. I do agree with detailing the violations in more detail but my management company is not an expert in landscaping or contruction so how would they know how to cure a violation? I do not approve of the passage of SB 130 as currently written. Feb-21-2013
