| For | The summer I left college, way back in 1975, a gay man was jumped and killed by 4 men waiting outside a tavern. The story was unusual in that it actually made headlines at the time. The sentencing judge gave the men what amounted to a 2 year slap on the wrist. In the LGBT community, knowledge of muggings, robberies, and assaults by those who would target our minority is well known but many times the stories were not reported and were treated in a very arbitrary way depending upon the judge who was officiating the case...if it was brought to trial at all. The mixed message was clear, gay people were different and crimes committed against them by those who would target them, not veiwed in the same light as with others. The death of Matthew Sheppard in Wyoming changed that and made many outside our community more aware of these hate crimes. Passage of a law like this will send a clear message to the justice system and provide an additional tool for those who prosecute these cases that the targeting of gay people by a violent and criminal element is not acceptable. Indeed, the targeting of anyone based on their gender, religion, ethnicity, race, or sexual orientation. should be unacceptable. I live for the day when those who would commit crimes specifically targeted to gay men and women are treated the same under the law and within the judicial system. Perhaps one day we will be recognized as equal and accepted by everyone and not targeted or judged solely by our orientation, but instead by our service to our country and to our community, and by the content of our character. If elevated status is conferred based on certain preconditions of the victim, then I petition the Senate include victims who possess left-handedness, lowered or heightened mental capacity, dyslexia, light eye color or other recessive biological traits, multiple-language skills ("expression"), presence of tattoos (another form of "expression"), etc. also be conferred with elevated protected status. | Against | Who can say what motivates a person to commit a crime? It is conjecture at best, and demagoguery at worst. Whether the crime is personal or impersonal -- that is, whether a victim is chosen at random or targeted specifically for some reason -- the fact remains that an ACT of crime was committed. It applies whether the assailant is a robber looking for valuables, or a bunch of drunken rednecks out to have some "fun" gay-bashing. The RESULT is the same, it is only the RESULT that can be objectively documented, litigated and punished. Does it matter that the robber might hate "rich" people? or gay-bashers hate gays? | Against | Welcome to the not-so-wonderful world of thought control! This is ridiculous -- criminalizing a person's thoughts. At the national level, it is considered a hate crime to kill a homosexual. What if the killing were a random act? But now the punishment will be worse because it's supposedly a hate crime. BUT somehow it's NOT a hate crime to walk into a church and start shooting Christians. The real purpose is not to punish crime but to shut off debate; you can't discuss "family values" without being accused of hating gays, you can't discuss the problems of inner city ghettos without being accused of hating blacks, you can't discuss immigration without being accused of hating Mexicans. Who exactly is doing the "hating" when they distort the debate in this manner? Anyone who simply expresses his opinions is now labeled racist, bigoted, intolerant, homophobic, extreme or whatever.
