| Against | As a homeowner in Summerlin, we purchased in this HOA because of the rules that govern many aspects of our home and surroundings. Allowing trash and recycling containers to be left up to the individual owners will cause severe degradation of our neighborhood. Many owners already violate the rules and leave trash in bags or boxes and then on windy days this trash is blown all over the neighborhood. This causes all other owners to have to pay for someone to pick up this improperly contained trash. Approval of this bill would not cause trash to be constantly left out in the neighborhood and blown about because it is not properly stored until pick up days. Proper storage of trash and recycling containers keeps the neighborhood clean and keeps the property values from deteriorating. We all currently follow the rules and changing it would just ignore the reasons we purchased in these communities with HOA's rules and regulations. | Apr-22-2013 |

Especially disturbing is letting the Commission determine the size, location, COLOR, material, and maximum cost to screen containers. | Against | This would make Association property look tacky when we are trying to make it look inviting to those who come into the community. | Against | AB44, trashy laws are the order of the day. I frequently disagree with Jonathan Friedrich (AB44 RJ business section article 2/26/13) because too often he tries to micro mange HOA processes. Here I share his concerns about this bill calling for how a homeowner can store their garbage. People buy into HOA’s because they like the idea that the rules spelled out in their bylaws will protect their property value. Then along comes the state legislature to override those covenants. I get it, sometimes change is necessary. But the legislature also needs to recognize that it take a two third majority vote for most HOA’s to permanently change their bylaws. This is very impractical and it rarely ever happens. So HOA boards must adopt rules in order to preserve some semblance of order. Adopting rules can be argumentative, costly and these rules are always subject to revision depending upon who is in charge at the time. The city of Las Vegas (CLV) won’t vote on the Republic’s proposal until this summer when the political coast is clear. Republic Services has heaped money on Steve Ross and others serving on the city council and also our state legislators, so for better or worse, change is likely happen. If AB44 passes, HOA’s may be forced to adopt new rules for trash storage. Something like, “all trash must be stored out of sight, in the garage, along side of the house (setback 10 feet or more) or in the rear yard.” As I recall the CLV ordinance states you can only put trash out up to 10 hours in advance. This is impractical and I don’t know if they ever enforce this code. If our legislators used common sense they would do all of this heavy lifting for 3,000 of us, but hey, far too many simply follow the money trail left by other lemmings. I’ll choose to wait and see what other more affluent HOA’s adopt. No need for our HOA and thousands of other HOA’s to absorb the legal costs individually. | Feb-26-2013 |

This bill would just end up financially hurting the citizens that are already strapped financially. | Against | Most of the people do not read NELIS. There is not one city in Nevada that requires invisibility of trash containers from adjacent property. This bill allows an HOA to force some, not all, unit owners to spend some undetermined amount of money to shield their trash containers supplied by City or County Ordinances from all adjacent property. OH, CHECK NELLIS. The Howard Hughes Corp. had a friendly amendment that was accepted by the bills sponsor. | For | Due to the size of the trash and recycle collection bins, I understand the need to be able to store the bins outside the garage or building. However, a significant aspect of the law permits HOAs' to promulgate rules regarding the erection of screens to hide the bins from street and sidewalk views. The law would require the Division to issue regulations providing guidance to HOAs' concerning the size, design and cost of these screens. It seems appropriate that the law should not become effective until some reasonable time after the issuance of the Regulations. Therefore, I strongly urge the Legislature to include such language that states the provisions of this bill would not become effective until six (6) months after the issuance of Regulations. The Division has a history of not issuing Regulations on a timely basis. If the Bill is enacted in its current form without the proposed change, the HOAs' will be left hanging with respect to controlling the placement and screening of bins. This will result in HOAs' either issuing Rules that are excessively restrictive or doing nothing, which will result in the bins being kept in plan sight, reducing the attractiveness of the community. | Feb-19-2013 |
| For | I am for any bill that limits the "requirements" that Homeowner's Associations can place on homeowners. They have gotten out of control with power. Requiring residents to keep their garbage cans indoors, especially now that some communities only receive waste collection ONCE A WEEK, is ludicrous. A week's worth of putrescible waste stored in a garage can really begin to create odors in a confined space and lessens the quality of life for the resident. Having trash cans outside under these conditions, especially in a Las Vegas summer, is perfectly reasonable. | Feb-06-2013 |
