GENERAL PROVISIONS

     NAC 407.005  Definitions. (NRS 407.0475, 407.065)  As used in this chapter, unless the context otherwise requires, the words and terms defined in NAC 407.006 to 407.0097, inclusive, have the meanings ascribed to them in those sections.

     NAC 407.006  “Administrator” defined. (NRS 407.0475, 407.065)  “Administrator” means the Administrator of the Division.

     NAC 407.0062  “Annual permit” defined. (NRS 407.0475, 407.065)  “Annual permit” means:

    1.  For any park except Cathedral Gorge State Park, Echo Canyon State Park, Spring Valley State Park, Kershaw-Ryan State Park, Beaver Dam State Park, Cave Lake State Park or Ward Charcoal Ovens State Historic Park, a permit which, for 12 months, authorizes the holder to enter the park and use the facilities of the park without paying the entrance fee imposed pursuant to NAC 407.055.

    2.  For Cathedral Gorge State Park, Echo Canyon State Park, Spring Valley State Park, Kershaw-Ryan State Park, Beaver Dam State Park, Cave Lake State Park or Ward Charcoal Ovens State Historic Park, a permit which, for 12 months, authorizes the holder to enter each one of those parks and use the facilities of that park without paying the entrance fee imposed pursuant to NAC 407.055.

     NAC 407.0063  “Boating” defined. (NRS 407.0475, 407.065)  “Boating” means the operation of a watercraft which is:

    1.  Launched or set adrift from a state park; and

    2.  Propelled by machinery or transported into the park by trailer.

     NAC 407.0065  “Camping” defined. (NRS 407.0475, 407.065)  “Camping” means any of the following activities engaged in for the purpose of, or in such a way as will permit, remaining overnight:

    1.  The occupation of a designated space with a vehicle;

    2.  The erection of a tent or shelter; or

    3.  The parking of a vehicle or the arrangement of bedding.

     NAC 407.0071  “Commercial photography” defined. (NRS 407.0475, 407.065)  “Commercial photography” means photography engaged in for financial gain, including, without limitation, the sale of a photographic image as a product or for use in advertising, motion pictures, television productions or portfolios and the archiving of an image by a person who uses photographic skills, equipment or resources to provide a photographic product for sale.

     NAC 407.0075  “Division” defined. (NRS 407.0475, 407.065)  “Division” means the Division of State Parks of the State Department of Conservation and Natural Resources.

     NAC 407.0077  “Entrance fee” defined. (NRS 407.0475, 407.065)  “Entrance fee” means the fee imposed by the Division for entrance to a park and the use of those facilities of the park for which the Division does not impose additional fees.

     NAC 407.008  “Group use” defined. (NRS 407.0475, 407.065)  “Group use” means the reserved use of designated facilities or areas by two or more people.

     NAC 407.0084  “Hook-up” defined. (NRS 407.0475, 407.065)  “Hook-up” means a connection for a utility service provided by a park for a vehicle in the park. The term includes, without limitation, a connection for electricity, water or sewer service.

     NAC 407.0088  “Off-highway vehicle” defined. (NRS 407.0475, 407.065)  “Off-highway vehicle” means a motorized vehicle of any size that is:

    1.  Operated or used exclusively off the roads or highways of this State; and

    2.  Not legally equipped for operation or use on such highways.

     NAC 407.009  “Park” defined. (NRS 407.0475, 407.065)  “Park” means any area that has been designated as a state park, historic state park, historic site, management area, monument or recreational area and is under the jurisdiction of the Division.

     NAC 407.0093  “Passport permit” defined. (NRS 407.0475, 407.065)  “Passport permit” means a permit that, for 12 months, authorizes the holder to enter all parks and, except as otherwise provided in NAC 407.054, use the facilities of the parks without paying the entrance fees imposed pursuant to NAC 407.055.

     NAC 407.0095  “Service animal” defined. (NRS 407.0475, 407.065)  “Service animal” has the meaning ascribed to it in NRS 426.097.

     NAC 407.0096  “Service animal in training” defined. (NRS 407.0475, 407.065)  “Service animal in training” has the meaning ascribed to it in NRS 426.099.

     NAC 407.0097  “Special use permit” defined. (NRS 407.0475, 407.065)  “Special use permit” means a permit that authorizes a natural person or a public or private organization to use a park for a special event or small or short-term business venture.

     NAC 407.010  Applicability. (NRS 407.0475, 407.065)

    1.  The provisions of NAC 407.050 to 407.150, inclusive, apply to all lands owned by or administered by the Division.

    2.  The prohibitions and restrictions of this chapter do not apply to employees of the Division while carrying out the duties of their employment.

PERMITS AND FEES

     NAC 407.050  Permits for senior citizens and commercial photography; miscellaneous fees. (NRS 407.0475, 407.065)

    1.  The Division will issue a permit for senior citizens to a resident of Nevada who applies for such a permit if the resident:

    (a) Is 65 years of age or older;

    (b) Has continuously resided in this State for the 5 years immediately preceding the date on which the resident submits the application;

    (c) Pays a $30 administrative fee;

    (d) Provides proof of age and residence in Nevada to the Division; and

    (e) Possesses a Nevada driver’s license or an identification card issued by the Department of Motor Vehicles.

Ê A permit for senior citizens authorizes the holder to enter, camp in and boat in all parks for 12 months after the date the permit for senior citizens is issued. The permit does not authorize the use of hook-ups without payment of the fee set forth in this section.

    2.  The Division will charge and collect the following fees:

(a) For the use of a facility for the dumping of sewage by a person not camping in the park................	The entrance fee for the park.
(b) For the use of the showers by a person not camping in the park	The entrance fee for the park.
(c) For making a camping reservation for individual campsites in a park designated by the Administrator as being available for camping reservations.	$10 per reservation per campsite, in addition to the camping fee or permit fee.
(d) For the reservation of stage areas............................................	The fee established by agreement or a special use permit, or both.
(e) For a passport permit...........	$100.
(f) To replace an annual permit, a passport permit or a permit for senior citizens..............................	$10.
(g) For a permit to operate an off-highway vehicle in a designated area of a park...............	$2 per off-highway vehicle.
(h) For the use of a campsite at which a hook-up is available.........     $	$10 per vehicle.
(i) For entrance into a park for which a fee is charged, an additional fee for all vehicles not registered in the State of Nevada...	$2 per vehicle.

    3.  For commercial bus tours, the Division will charge and collect the established entrance fee or $2 per person, whichever is greater, or the fee established by a special use permit. A special use permit may provide for monthly billings.

    4.  For each day or partial day that a person engages in commercial photography in a park, the Division will charge and collect the following fee according to the total number of vehicles or the total number of persons, whichever results in a higher fee:

The Division will waive the entrance fee for the park upon payment of the fee for a commercial use permit for photography.

    5.  A person who has obtained a commercial use permit for photography may request that the Division reserve an area within the park for use in accordance with the terms of the permit. Upon receipt of such a request, the Division will charge and collect a reservation fee of $100. The reservation fee is in addition to any fee charged and collected pursuant to subsection 4.

    6.  The Division will not charge a fee pursuant to this section for:

    (a) Commercial photography engaged in by one to five persons in a single vehicle; or

    (b) Photography engaged in for noncommercial, educational purposes, to promote the park or to report news in any form of media, including, without limitation, newspapers and television.

    7.  If a user of a park does not deposit the required fee in the available self-service devices, the Division:

    (a) Will charge the user a fee of $2 for collection service, in addition to other fees; and

    (b) May file criminal charges against the user for theft as defined in NRS 205.0832.

    8.  For each special use permit or commercial use permit, the Division will charge a processing fee of $25 in addition to any other fee charged for the permit.

    9.  The Division will reduce by $1 any entrance fee established pursuant to this chapter charged to a person who holds a disability placard and presents it upon entrance to a park.

     NAC 407.052  Multipurpose annual permits. (NRS 407.0475, 407.065)

    1.  A person who applies for a multipurpose annual permit for the use of:

    (a) Lahontan State Recreation Area will be issued such a permit upon payment of a fee of $200.

    (b) South Fork State Recreation Area, Rye Patch State Recreation Area and Wild Horse State Recreation Area will be issued such a permit upon payment of a fee of $150.

    2.  A person who applies for a multipurpose annual boating permit for the use of:

    (a) Lake Tahoe Nevada State Park will be issued such a permit upon payment of a fee of $200.

    (b) Rye Patch State Recreation Area or Washoe Lake State Park will be issued such a permit upon payment of a fee of $100.

    (c) Wild Horse and South Fork State Recreation Areas will be issued such a permit upon payment of a fee of $100.

    (d) Big Bend of the Colorado State Recreation Area will be issued such a permit upon payment of a fee of $125.

    3.  A permit issued pursuant to subsection 1 authorizes the holder of the permit to enter, camp in and boat in the park for which it is issued without paying the entrance, camping and boating fees imposed by NAC 407.055.

    4.  A permit issued pursuant to subsection 2 authorizes the holder of the permit to enter and boat in the park or parks for which it is issued without paying the entrance and boating fees imposed by NAC 407.055.

     NAC 407.053  Establishment of procedures, conditions and fees for special use permit. (NRS 407.0475, 407.065)  The Administrator will establish procedures, conditions and fees for obtaining a special use permit.

     NAC 407.054  Limitations on passport permit. (NRS 407.0475, 407.065)

    1.  A passport permit does not authorize the holder to engage in camping or boating, or to attend special events.

    2.  The holder of a passport permit who wishes to engage in camping or boating, or to attend special events, must pay the fee established for the respective activity.

     NAC 407.055  Fees for use of parks. (NRS 407.0475, 407.065)

    1.  Except as otherwise provided in NAC 407.050 and 407.052, or unless waived, the Division will charge and collect the following fees for the use of parks:

 

 

    2.  A person who pays an entrance fee pursuant to subsection 1 is not authorized to use the facilities of the park from 10 p.m. until 6 a.m. unless the person also pays the camping fee for the park.

    3.  Except as otherwise provided in this subsection, the Division will charge and collect from each person who rides a bicycle or horse, walks or enters by vessel into a park an entrance fee of $1. The Division will charge and collect from each person who rides a bicycle into Spooner Management Area an entrance fee of $2.

    4.  The Division will not charge a fee for any vehicle that is towed into a park.

    5.  The Division will charge, in addition to any other fee imposed pursuant to this chapter, a fee of $2 for each watercraft in excess of two that is launched from a boat ramp.

    6.  If a person purchases an annual permit to a park for a vehicle, the person may purchase at the same time a second annual permit to the same park at a discounted price equal to one-half of the price of the annual permit. The annual permit purchased at a discounted price must be for a vehicle registered to the same owner at the same residence as the owner of the vehicle for which the permit was purchased at regular price.

     NAC 407.057  Waiver of fees. (NRS 407.0475, 407.065)  A park supervisor or regional manager in charge of a region in which a park is located may waive the fees for the use of a park under circumstances specified by the Administrator.

     NAC 407.060  No refund of fees where privileges rescinded for infractions. (NRS 407.0475, 407.065)  Fees charged for the use of a park will not be refunded if the user’s privileges are rescinded as a result of the infraction of a park regulation.

MANAGEMENT OF PARKS

     NAC 407.061  Prohibition against disregarding lawful order of employee of Division. (NRS 407.0475, 407.065)  A person shall not disregard a lawful order of an employee of the Division.

     NAC 407.062  Opening and closing times for parks or areas in parks. (NRS 407.0475, 407.065)  The Administrator or the Administrator’s designee will establish opening and closing times for a park or an area in a park.

     NAC 407.063  Posting of opening and closing hours, restrictions and prohibitions; filing of affidavit of posting. (NRS 407.0475, 407.065)

    1.  The ranger in charge of a region or the supervisor of a park shall post at the headquarters of the park and at each affected area in the park:

    (a) The opening and closing hours of the park or the area; and

    (b) Any restrictions or prohibitions on the use of the park or the area.

    2.  An affidavit of posting with a copy of the opening and closing hours, restrictions and prohibitions attached to the affidavit must be filed in the offices of the ranger in charge of the region and the Administrator.

     NAC 407.065  Procedure for registration of participant in recreational activity. (NRS 407.0475, 407.065)

    1.  The supervisor of a park may prescribe the procedure for registration of a participant in any recreational activity.

    2.  As used in this section, recreational activity includes, but is not limited to, rock climbing, rappelling, hang gliding, hiking, parasailing, skiing, scuba diving and horseback riding.

     NAC 407.067  Procedure for reserving campsite, area or facility. (NRS 407.0475, 407.065)  The supervisor of a park shall prescribe the procedure for reserving a campsite, an area or a facility within a park.

     NAC 407.069  Closure of or restriction of access to designated areas. (NRS 407.0475, 407.065)  A supervisor of a park may close or restrict access to a designated area within the park to protect natural and cultural resources, provide for public safety, provide security, or allow for maintenance or rehabilitation of the area.

GENERAL RESTRICTIONS ON USE

     NAC 407.080  Camping. (NRS 407.0475, 407.065)

    1.  A person shall not camp:

    (a) In a place restricted to use during the day or in an area not designated as a camping area unless approved by the supervisor of the park; or

    (b) For more than 14 days in a 30-day period unless a longer or shorter time is designated by the supervisor of the park and is approved by the regional manager of the region in which the park is located.

    2.  Unless a campsite is reserved, camping is on a first-come, first-served basis.

    3.  If the applicable fee has not been paid or if the time for occupancy has expired, the occupant of a campsite shall remove any property of the occupant from the campsite by 2 p.m. on the day the fee is due or by the time designated by the supervisor of the park.

    4.  The occupant of a campsite shall not leave it unoccupied overnight without the permission of the supervisor of the park.

    5.  No more than two motorized vehicles, a combination of a motorized vehicle and a towed vehicle, or eight persons may occupy one campsite unless the supervisor of the park:

    (a) Authorizes a greater number of vehicles;

    (b) Restricts parking to fewer than two vehicles; or

    (c) Restricts the occupancy of a campsite to fewer than eight persons.

    6.  A person may not save a campsite for use by other persons.

     NAC 407.082  Use of park without paying fee. (NRS 407.0475, 407.065)

    1.  Unless the fee is waived pursuant to NAC 407.057, a person shall not:

    (a) Enter, use or occupy any portion of a park for which an entrance fee has been established by the Administrator unless the person has first paid the fee.

    (b) Camp, occupy a cabin or moor a vessel in a portion of a park after the closing time or before the opening time for that portion of the park unless the person has first paid the fee.

    2.  A person who violates this section may be subject to criminal charges for theft as defined in NRS 205.0832.

    3.  This section does not apply to persons exempted by the Administrator, the Deputy Administrator or the regional manager of the region in which the park is located.

     NAC 407.085  Use of park for organized activity, event or other purpose. (NRS 407.0475, 407.065)  Unless authorized pursuant to a special use permit, a person shall not use a park for any organized activity, event or other purpose, if such use of the park:

    1.  Involves the exclusive use of a facility of the park that is not allocated for the activity or event;

    2.  Involves the interruption of normal recreational activity;

    3.  Presents a potential for public liability or hazardous consequences not present in the normal recreational patterns of the park;

    4.  Requires additional services, facilities or equipment that are not normally provided to the general public;

    5.  Is not recognized as a valid recreational use of the park; or

    6.  Involves an organized or promoted assembly of more than 20 persons.

     NAC 407.087  Use of water supply of park. (NRS 407.0475, 407.065)  Unless approved by the supervisor of the park, the water supply of the park may be used only for recreational purposes by the general public. Water removed from the park is restricted to 10 gallons per vehicle or the holding capacity of the water tanks of a recreational vehicle.

     NAC 407.088  Commercial use of park. (NRS 407.0475, 407.065)

    1.  In a park no person may:

    (a) Without the approval of the Administrator, post or distribute a handbill, notice or advertisement.

    (b) Without a concession permit or commercial use permit granted by the Administrator:

        (1) Sell or offer to sell any goods or services.

        (2) Use a park for any other commercial purpose.

    2.  As used in this section, “commercial purpose” means any activity that is engaged in for financial gain, including, without limitation, the buying, selling or other exchange of commodities or the providing of services related to or connected with trade, traffic or commerce in general.

     NAC 407.090  Fires; firewood or other combustibles. (NRS 407.0475, 407.065)

    1.  In a park, a person shall not light, build or maintain a fire:

    (a) Except in a portable stove, a barbecue or a fireplace; or

    (b) On the ground, unless the fire is in an enclosure provided by the Division or approved by the supervisor of the park.

    2.  Firewood or other combustibles must be contained within the rims of grills or stoves provided by the Division. Any material to be burned must not be longer than 22 inches or contain any nails, screws or other fasteners or other metal objects.

     NAC 407.101  Fireworks and explosives. (NRS 407.0475, 407.065)  No person may possess or discharge within or into any portion of a park any firecracker or other fireworks, or explosives.

     NAC 407.103  Metal detector. (NRS 407.0475, 407.065)  Except as authorized by the supervisor of the park, no person may use a metal detector in the park.

     NAC 407.105  Possession or use of weapons. (NRS 407.0475, 407.065)

    1.  In any park, a person shall not:

    (a) Use a bow and arrow, slingshot or paint ball launcher;

    (b) Possess a firearm, unless:

        (1) The firearm is unloaded and inside a vehicle; or

        (2) The person in possession of the firearm has a permit to carry a concealed firearm issued pursuant to the provisions of NRS 202.3653 to 202.369, inclusive, and is carrying the firearm in conformity with the terms of the permit;

    (c) Discharge a weapon, including, without limitation, an air rifle, spring gun or air pistol; or

    (d) Throw a knife, hatchet, spear, stone or projectile,

Ê except as authorized by the Administrator.

    2.  The Administrator may designate zones in which a person may, for the purposes of hunting a species that is designated by the Board of Wildlife Commissioners as a game mammal or game bird pursuant to chapter 503 of NAC, carry and discharge a firearm or bow in accordance with the regulations of the Department of Wildlife. At each park in which a zone is designated pursuant to this subsection, the ranger in charge of the region or the supervisor of the park shall post at the headquarters of the park, and at each area within the park which is designated as a zone in which a person may carry and discharge a firearm or bow for the purposes of hunting, maps of the designated zones within that park.

    3.  Target shooting is prohibited in all areas of a park, except in an area designated as a firing range.

    4.  Use of a bow to kill, capture or injure a fish is prohibited within 100 feet of a swimmer.

     NAC 407.107  Wildlife. (NRS 407.0475, 407.065)  Except when hunting in accordance with the regulations of the Department of Wildlife, a person shall not disturb, feed, injure or kill any wildlife within a park.

     NAC 407.110  Sanitation. (NRS 407.0475, 407.065)  No person may:

    1.  Use any trash can or other facility for refuse in a park to dispose of garbage or other waste brought into the park.

    2.  Clean fish, food, clothing or kitchenware at any place that the supervisor of the park has not authorized for that use.

     NAC 407.115  Glass containers on beach or waterfront area. (NRS 407.0475, 407.065)  A person shall not bring or have a glass container on any beach or waterfront area in a park.

     NAC 407.120  Vehicles, trailers and other personal property: Prohibited acts. (NRS 407.0475, 407.065)  Unless authorized by the supervisor of the park, a person shall not:

    1.  Park any vehicle or trailer in any area not designated as a parking area;

    2.  Park any vehicle or trailer in more than one parking space at a time;

    3.  Park any vehicle or trailer overnight;

    4.  Leave any personal property in the park overnight; or

    5.  Except as otherwise provided in NAC 407.122, drive a snowmobile, all terrain vehicle, motorcycle or moped, or ride a bicycle, motorized skateboard or skateboard, or drive or ride any other vehicle on a trail, or in any area which has not been specifically designated or developed for that use.

     NAC 407.121  Vessels, vehicles and other personal property: Parking, abandoning or leaving unattended; impoundment. (NRS 407.0475, 407.065)

    1.  A person shall not park, abandon or leave unattended any vessel, vehicle or other personal property in a park in violation of this chapter without the approval of the supervisor of the park or the supervisor’s designee.

    2.  Any vehicle, vessel or personal property parked, abandoned or left unattended in violation of subsection 1 may be impounded or stored at the expense of the owner of the vehicle, vessel or personal property.

     NAC 407.122  Off-highway vehicles. (NRS 407.0475, 407.065)

    1.  If the Administrator deems the use of off-highway vehicles to be appropriate in a park, the Administrator may grant final approval to designate areas in the park for the use of off-highway vehicles.

    2.  A person may drive or operate an off-highway vehicle in a park if:

    (a) The person obtains a permit to operate an off-highway vehicle in the park;

    (b) The person is 14 years of age or older;

    (c) The person and any passengers in the off-highway vehicle each wear a helmet that meets or exceeds the standards regarding impact and retention set forth in 49 C.F.R. § 571.218; and

    (d) The person operates the off-highway vehicle:

        (1) In a designated area for which the Administrator has granted final approval pursuant to subsection 1;

        (2) At a rate of speed that is reasonable and proper, having due regard to the conditions of the driving surface, the weather and other conditions;

        (3) In any event, at a speed that is not greater than 20 miles per hour; and

        (4) In a safe manner.

     NAC 407.125  Aircraft. (NRS 407.0475, 407.065)  No person may, in an aircraft, except an aircraft which is propelled into the air by the speed of a boat, land or take off from any body of water or area of a park not specifically approved by the supervisor of the park for landing aircraft.

     NAC 407.131  Boats. (NRS 407.0475, 407.065)

    1.  A person shall not secure a boat to a dock except to load or unload a person or equipment.

    2.  Only a person who has paid the entrance fee for a park may:

    (a) Use a boat slip; or

    (b) Moor a vessel overnight.

     NAC 407.133  Recreational equipment of nonpersonal nature. (NRS 407.0475, 407.065)  A person may not bring recreational equipment of a nonpersonal nature into a park, including, without limitation, an inflatable floating trampoline or other trampoline, a stationary floating platform, a dunk tank, a climbing wall or a bounce house, without the approval of the supervisor of the park or the supervisor’s designee.

     NAC 407.135  Livestock. (NRS 407.0475, 407.065)  No person may:

    1.  Graze livestock within a park without the written approval of the Administrator.

    2.  Keep, lead or ride a horse in any area that is not designated for equestrian use without the written approval of the supervisor of the park.

     NAC 407.140  Pets and other domestic animals. (NRS 407.0475, 407.065)  Except as otherwise provided in NAC 407.251 and 407.370, a person shall not:

    1.  Bring a pet or other domestic animal into a park unless the pet or domestic animal is:

    (a) Caged;

    (b) Contained inside an automobile, trailer, motor home, camper or other vehicle; or

    (c) Kept upon a leash no longer than 6 feet.

    2.  Permit a pet or other domestic animal to create a nuisance or disturbance.

    3.  Fail to clean up waste deposited by a pet or other domestic animal.

    4.  Fail to control a pet or other domestic animal properly.

    5.  Unless written approval is given by the supervisor of a park, have a pet or other domestic animal, other than a service animal or service animal in training, at a beach for swimming, inside a building, or in any other area which the supervisor of the park has designated as an area closed to pets or other domestic animals.

     NAC 407.145  Curfew. (NRS 407.0475, 407.065)

    1.  The ranger in charge of a region may declare a curfew for juveniles in any park or part of a park upon finding that it is necessary for the protection of the safety and welfare of the public. The order for the curfew must:

    (a) Specify the hours of the curfew;

    (b) Specify the length of time the order is in effect; and

    (c) Be posted in a conspicuous place in the park.

    2.  If a curfew has been ordered, no juvenile may enter or remain in the park during the period of the curfew unless the juvenile is:

    (a) Accompanied by a parent or guardian;

    (b) Part of a group which is authorized to occupy the park and is supervised by at least 1 adult for each 10 juveniles; or

    (c) Lawfully camping and has furnished to the ranger in the park the written consent of his or her parent or guardian which includes, without limitation, the full name, address and telephone number of the parent or guardian and the dates for which permission to camp is granted.

     NAC 407.150  Quiet hours. (NRS 407.0475, 407.065)  A person shall not:

    1.  Disturb others between 10 p.m. and 7 a.m.;

    2.  During those hours, use electronic equipment or machinery at a volume which can be heard beyond the immediate campsite without the written permission of the supervisor of the park; or

    3.  Operate a generator between 10 p.m. and 7 a.m.

RESTRICTIONS ON USE OF SPECIFIC PARKS AND AREAS

     NAC 407.211  Big Bend of the Colorado State Recreation Area. (NRS 407.0475, 407.065)  Within Big Bend of the Colorado State Recreation Area, a person shall not:

    1.  Tie a boat to a dock for any purpose other than to perform an activity related to loading, unloading or launching the boat; or

    2.  Dive from or swim within 50 feet of a dock which is used to launch boats.

     NAC 407.225  Cave Lake State Park. (NRS 407.0475, 407.065)  Within Cave Lake State Park, a person shall not camp for more than 7 days in a 30-day period.

     NAC 407.240  Dayton State Park. (NRS 407.0475, 407.065)

    1.  Within the Dayton State Park, a person shall not:

    (a) Enter the water or stand in a canal or headgate; or

    (b) Camp for more than 7 days in any 30-day period.

    2.  To use Dayton State Park, a group of 201 or more persons must obtain a special use permit from the Division.

     NAC 407.251  Echo Canyon State Park. (NRS 407.0475, 407.065)  Within Echo Canyon State Park, the provisions of subsection 1 of NAC 407.140 apply only within a 200-foot radius of any campsite. Outside that area, a pet or other domestic animal is not required to be kept on a leash or otherwise contained if it is under the immediate control of the owner.

     NAC 407.270  Fort Churchill State Historic Park. (NRS 407.0475, 407.065)  Within Fort Churchill State Historic Park, a person shall not pass over or under, or damage any fence of the Park.

     NAC 407.285  Kershaw-Ryan State Park. (NRS 407.0475, 407.065)  Within Kershaw-Ryan State Park, a person shall not:

    1.  Allow an animal to enter the pond;

    2.  If the person is under 16 years of age, enter the pond without the supervision of an adult; or

    3.  Camp for more than 7 days in any 30-day period.

     NAC 407.290  Lahontan State Recreation Area. (NRS 407.0475, 407.065)  Within Lahontan State Recreation Area, a person shall not:

    1.  Use any part of the Recreation Area for a musical concert without the permission of the Supervisor of the Recreation Area;

    2.  Engage in any aquatic sport within the area around the dam marked by buoys or in any spillway or canal; or

    3.  Use a chainsaw within any part of the Recreation Area without approval from the Supervisor of the Recreation Area.

     NAC 407.300  Lake Tahoe Nevada State Park. (NRS 407.0475, 407.065)  Within the Lake Tahoe Nevada State Park, a person shall not:

    1.  Fish in any area designated for swimming;

    2.  Swim within 50 feet of a boat dock;

    3.  Dive off any rocks within an area controlled by the Division;

    4.  Leave any vehicle, vessel, trailer or other property within the Park overnight or after the Park is closed without the prior approval of the Supervisor of the Park; or

    5.  Operate any bicycle in a manner which jeopardizes the safety of others. Riders must maintain a reasonable speed on dirt roads.

     NAC 407.302  Sand Harbor Management Area. (NRS 407.0475, 407.065)  Within the Sand Harbor Management Area:

    1.  A person shall not:

    (a) Tie a boat or other watercraft to the shoreline with more than 6 feet of line extending up to the beach;

    (b) Bring a pet or other domestic animal into the Management Area;

    (c) Barbecue on any beachfront area;

    (d) Operate a hard-bottom boat within any area marked with buoys or other distinguishing devices as closed to boats;

    (e) Bring fuel used for the operation of a boat or other watercraft onto a beach, unless the fuel is contained in a spill-proof container and the area of water adjacent to the beach is designated for boating; or

    (f) Engage the propeller of an engine-driven boat or other watercraft to load the craft onto a trailer if the pool elevation of the lake is at or below 6,225 feet above sea level.

    2.  Watercraft operated in an area controlled by the Division must:

    (a) Be attended;

    (b) Be removed from the water before fueling; and

    (c) Not be moored or anchored during hours that are not the operating hours of the Management Area.

    3.  Each person who scuba dives shall:

    (a) Obtain prior approval from the Supervisor of the Management Area before diving after the normal operating hours of the Management Area.

    (b) Not dive in an area unless it is an area designated for diving.

     NAC 407.304  Spooner Management Area. (NRS 407.0475, 407.065)  Within the Spooner Management Area:

    1.  A person shall not engage in any recreational activity in the area in which operations for cross-country skiing are conducted that conflicts with the cross-country skiing, except as authorized by the Supervisor of the Park; and

    2.  No pets or other domestic animals are allowed on the groomed trails for cross-country skiing.

     NAC 407.306  Cave Rock Management Area. (NRS 407.0475, 407.065)  Within the Cave Rock Management Area, a person shall not:

    1.  Scuba dive except in the southern area of the beach; or

    2.  Bring any pet or other domestic animal onto the sandy area of the beach.

     NAC 407.308  Marlette and Hobart Management Areas. (NRS 407.0475, 407.065)  Within the Marlette Management Area or the Hobart Management Area:

    1.  A horse or other animal used for riding or carrying food or equipment must not:

    (a) Enter or travel in any meadow, glade or grove of aspen;

    (b) Graze in the watershed of the Marlette or Hobart Management Area; or

    (c) Be within 200 feet of the water of the Hobart Reservoir.

    2.  A person shall not operate a motorized vehicle unless he or she has been issued a backcountry permit by the Supervisor of the Lake Tahoe Nevada State Park, except that an employee of:

    (a) The State Department of Conservation and Natural Resources;

    (b) The Buildings and Grounds Division of the Department of Administration; or

    (c) The United States Forest Service,

Ê may operate such a vehicle in the performance of the employee’s official duties.

    3.  A person shall not ride a bicycle except on a trail designated as approved for use by bicycles.

     NAC 407.315  Old Las Vegas Mormon Fort State Historic Park. (NRS 407.0475, 407.065)  Within Old Las Vegas Mormon Fort State Historic Park, a person shall not:

    1.  Have any pet or other domestic animal except a service animal or service animal in training; or

    2.  Operate a bicycle or any motor vehicle on a path.

     NAC 407.317  Rye Patch State Recreation Area. (NRS 407.0475, 407.065)  Within Rye Patch State Recreation Area, a person shall not swim, wade or engage in other aquatic sports within 400 feet of the spillway of the dam.

     NAC 407.320  Spring Mountain Ranch State Park. (NRS 407.0475, 407.065)  Within Spring Mountain Ranch State Park, no person may:

    1.  Leave a vehicle or equipment overnight in an area restricted to use during the day;

    2.  Operate a public address system, loud speaker or amplifier without the approval of the Supervisor of the Park;

    3.  Play baseball, softball, volleyball or golf or pitch horseshoes on the grass;

    4.  Swim, wade, boat or engage in aquatic sports in Lake Harriet; or

    5.  Bring personal charcoal barbecues or fryers into the Park.

     NAC 407.331  South Fork State Recreation Area. (NRS 407.0475, 407.065)  Within South Fork State Recreation Area, a person shall not engage in an aquatic sport or activity within the area of the spillway of the dam.

     NAC 407.340  Spring Valley State Park. (NRS 407.0475, 407.065)  Within Spring Valley State Park, no person may:

    1.  Engage in any aquatic sport within the area of the spillway of the dam;

    2.  Enter into the spillway tunnel; or

    3.  Camp for more than 7 days in a 30-day period.

     NAC 407.350  Valley of Fire State Park. (NRS 407.0475, 407.065)

    1.  Within the Valley of Fire State Park, a person shall not climb a rock formation or otherwise engage in rock climbing except in an area designated for such climbing by the Supervisor of the Park.

    2.  A person climbing in such an area:

    (a) May use ropes, carabiners, web belts, webbing and cushioning materials.

    (b) Shall not use any pitons, chocks, or other such climbing devices or any magnesium carbonate chalk in climbing unless:

        (1) The person is engaged in emergency rescue operations; or

        (2) The Supervisor of the Park approves the use of such devices or chalk.

     NAC 407.365  Ward Charcoal Ovens State Historic Park. (NRS 407.0475, 407.065)  Within Ward Charcoal Ovens State Historic Park, a person shall not climb on a historic charcoal oven.

     NAC 407.370  Washoe Lake State Park. (NRS 407.0475, 407.065)  Within Washoe Lake State Park:

    1.  A person shall not:

    (a) Operate any motorized toy or device which is controlled by a radio in any congested area of the Park;

    (b) Camp for more than 7 days in a 30-day period;

    (c) Enter the wetland area from February 1 through June 30 without the permission of the Supervisor of the Park; or

    (d) Permit a dog to enter the wetland area except during the seasons for hunting waterfowl established by the Department of Wildlife; and

    2.  The provisions of subsection 1 of NAC 407.140 apply only within a 200-foot radius of any campsite or developed picnic area. Outside that area, a pet or other domestic animal is not required to be kept on a leash or otherwise contained if it is under the immediate control of the owner.
