CHAPTER 679A - INSURANCE: GENERAL PROVISIONS

679A.005     “Policy of liability insurance” interpreted.

679A.007        Applicability of prohibition against inclusion in policy of liability insurance of provisions relating to costs of defense, legal costs and fees and other expenses for claims.

679A.010        Severability.

679A.020        Entities organized for purpose of or engaged in business of insurance.

 

 

 

      NAC 679A.005  “Policy of liability insurance” interpreted. (NRS 679B.130)  As used in NRS 679A.210, “policy of liability insurance” includes only a policy of casualty insurance that:

     1.  Provides insurance against legal liability arising from the ownership or operation of a motor vehicle, as defined in NRS 485.050;

     2.  Provides insurance against legal liability arising from the ownership of housing that is occupied by the owner as the primary residence of the owner;

     3.  Is a policy of commercial general liability insurance;

     4.  Is a policy of commercial automobile insurance; or

     5.  Provides insurance covering the professional liability of a provider of health care, as defined in NRS 41A.017.

REVISER’S NOTE.

      The regulation of the Commissioner of Insurance filed with the Secretary of State on November 6, 2023 (LCB File No. R029-23), the source of this section, contains the following provision not included in NAC:

      “Sec. 4.  This regulation is hereby amended by adding thereto the following transitory language which has the force and effect of law but which will not be codified in the Nevada Administrative Code:

      The provisions of this regulation do not apply to a contract for liability insurance existing on October 1, 2023, but the provisions of this regulation do apply to a contract for liability insurance to which the provisions of section 1 of Assembly Bill No. 398, chapter 191, Statutes of Nevada 2023, at page 1110, [NRS 679A.210] are applicable pursuant to section 2 and 3 of this regulation [NAC 679A.005 and 679A.007, respectively] that is issued or renewed on or after October 1, 2023.”

 

      NAC 679A.007  Applicability of prohibition against inclusion in policy of liability insurance of provisions relating to costs of defense, legal costs and fees and other expenses for claims. (NRS 679B.130)  The provisions of NRS 679A.210 do not apply to:

     1.  A risk retention group, as defined in NRS 695E.110.

     2.  Captive insurance that does not cover third-party liability.

     3.  A nonadmitted insurer, as defined in NRS 685A.0375.

      NAC 679A.010  Severability.  If any provision in chapters 679A to 697A, inclusive, of NAC or any application thereof to any person, thing or circumstance is held invalid, the Commissioner of Insurance intends that such invalidity not affect the remaining provisions or applications to the extent that they can be given effect.

      NAC 679A.020  Entities organized for purpose of or engaged in business of insurance. (NRS 679B.130)  For the purposes of NRS 86.141 and 88.342, an entity is organized for the purpose of or engaged in the business of insurance if the entity acts as:

     1.  An insurer pursuant to NRS 679A.100;

     2.  A fraternal benefit society pursuant to chapter 695A of NRS;

     3.  A nonprofit corporation for hospital, medical and dental service pursuant to chapter 695B of NRS;

     4.  A health maintenance organization pursuant to chapter 695C of NRS;

     5.  An organization for dental care pursuant to chapter 695D of NRS;

     6.  A risk retention group pursuant to chapter 695E of NRS; or

     7.  A prepaid limited health service organization pursuant to chapter 695F of NRS.
